சென்ற வாரம் வெள்ளிக்கிழமை பிரதமர் அறிவித்திருந்த 2013 – ஆம் ஆண்டுக்கான வரவு செலவு திட்டத்தில் தலைவிரித்தாடிக் கொண்டிருக்கும் குற்றச் செயல்களுக்கு முற்றுப் புள்ளி வைக்க மத்திய அரசாங்கம் ஒதுக்கியுள்ள ஒதுக்கீடு ஆக்ககரமான முடிவல்ல என்று சாடினார் கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ.
வன்பொருட்களை வாங்குவதற்கும், காவல் துறையில் மனித வளத்தை அதிகரிப்பிற்கும் செலவு செய்வதால் அதிகரித்துக் கொண்டிருக்கும் குற்றச் செயல் பிரச்சனையை தீர்த்து விட முடியாது. மிக அவரசரமாக செயல்படுத்த வேண்டியது என்னவென்றால் யுக்திகளில் மாற்றமும், வளங்களில் மறு ஒதுக்கீடும் மட்டும் தான் என்றார்.
1000 மோட்டர் சைக்கிள்கள் வாங்குவதன் மூலம் குற்றச் செயல்களை எப்படி குறைக்க முடியும்? அல்லது 25 உள்ளூர் நகரங்களில் 496 சிசிடிவி காமெராக்கள் பொருத்துவதின் வலி காவல் துறையினர் மீது மக்கள் இழந்துக் கிடக்கும் நம்பிக்கையை உருவாக்கத்தான் முடியுமா? என கேள்வி எழுப்பிய சார்ல்ஸ், இதற்கு பதிலாக மிகுந்து கிடக்கும் குற்றவியல் அல்லா பிரிவில் இருக்கும் போலீஸ் அதிகாரிகளை குற்றவியல் பிரிகளுக்கு மாற்றப் பட வேண்டும்.
தற்போது குற்றவியல் துறையில் (குற்றவியல் விசாரணை பிரிவு, போதைப் பொருள் மற்றும் வணிக குற்ற புலனாய்வு) துறையில் சீருடை அணிந்த போலிஸ் அதிகாரிகள் 14% மட்டுமே. அதற்கு மாறாக, குற்றவியல் சார்பற்ற துறையில் (நிர்வாகம், உள்நாட்டு பாதுகாப்பு மற்றும் பொது ஒழுங்கு, தளவாடங்கள், சிறப்பு பிரிவு மற்றும் சிறப்பு பணி பிரிவு) ஆகிய பிரிவில் மொத்தம் 86% போலிஸ் அதிகாரிகள் உள்ளனர். அதிக ஒதுக்கீடு வழங்க வேண்டிய குற்றவியல் பிரிவிற்கு கடந்த மூன்று வருடங்காலங்களில் 8% மட்டுமே ஒதுக்கப் பட்டுள்ளது.
ஆகவே, குற்றச் செயல்களை குறைப்பதற்கு பணத்தை வாரி கொடுக்க எண்ணம் கொண்டிருக்கும் அரசாங்கம் தற்போது ஆக்ககரமின்றி செயல் படும் காவல் துறையை, இருக்கும் படையை வைத்து எவ்வாறு ஆக்ககரமாகவும் திறன் படவும் செயல் பட முடியும் என்பதற்கான யுக்திகளை கொண்டு வந்து செயல் படவேண்டும். மோட்டார் சைக்கிள்களில் மின்னல் வேகத்தில் ரோந்து போகும் போலிஸ் அதிகாரிகள் குறிப்பிட்ட சில இடங்களில் பரிசோதனைகளையும் மெல்லிய விசாரணைகளையும் மேற்கொள்ளலாம். குற்றச் செயல் துணிச்சலாக இறங்கி செய்பவர்களை பார்க்கும் போது போலீஸ் மீது அவர்களுக்கு இருக்கும் பய அளவை தெளிவாக உணர முடிகின்றது. ஆக, மக்களிடம் எழுந்திருக்கும் பயத்தை போக்க குற்றம் செய்பவர்களிடம் பயத்தை உருவாக்க வேண்டிய அவசியத்தில் நமது போலிஸ் படை உள்ளது என்பதனை பிரதமர் மறந்து விடக் கூடாது.
மேலும், மக்கள் விழிப்புணர்வுடன் இருப்பது மிக அவசியம் என வலியுறுத்திய சார்ல்ஸ், குற்றச் செயல் பளிகடாவகுவதிளிருந்து நம்மை நாம் தடுக்க நடவடிக்கைகளை எடுத்தாக வேண்டும். அதற்காக சில நடவடிக்கைகளை தாம் தனது தொகுதி மக்களுக்காக மேற்கொண்டு வருவதாகவும் சார்ல்ஸ் தெரிவித்தார்.

சம்பந்தப் பட்ட சில தரப்புகள் வெளியிடும் குறியீடுகள் குற்றச்செயல்கள் குறைந்துள்ளன என கூறினாலும் மலேசியாவில் நாளுக்கு நாள் குற்றச்செயல்கள் அதிகரித்துக் கொண்டு வருவதை நாம் அனைவரும் அறிவோம். ஒவ்வொரு நாளும் குறைந்தது ஐந்து அல்லது ஆறு குற்றச்செயல் சம்பவங்கள் நாளிதழ்களிலும் செய்திகளிலும் வெளியாகுவது மட்டுமில்லாமல், நாமோ அல்லது நமக்கு தெரிந்தவர்களோ குற்றச்செயல் பலிகடவாகிவருகின்றோம் என்பது மறைக்க முடியாத உண்மையே.
அண்மையில், “எனது பேஸ்புக் அல்லது முகப்புத்தகத்தில் ஒருவர் கிள்ளான் தொகுதியில் வாழும் தனது தந்தை வீட்டின் நுழைவாயிலேயே கொள்ளையிடப்பட்ட சம்பவத்தை பகிர்ந்துக் கொண்டார். இதில் வருந்தத்தக்க விசயம், இது அவரது மூன்றாவது அனுபவம் என்பதே. மறுபக்கம் அவரது அண்டை வீட்டில் இரண்டு முறை கொள்ளையர்கள் வீட்டை உடைத்து கொள்ளையிட்டுள்ளனர்” என விவரித்தார் கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ.
தாமான் கெம்பிராவில் வாழும் மற்றொருவர், தனது அண்டை வீட்டார் பட்டப்பகலில் பாரங்கத்தி ஏந்திய நான்கு ஆடவர்களால் கொள்ளயிடப்பட்டதாகவும் வருத்ததுடன் தெரிவித்திருந்தார்.
இவ்வாறான கொடூர சம்பவங்கள் மலேசியாவில் ஆங்காங்கு நடந்துக் கொண்டிருப்பது மட்டுமில்லாமல் குற்றச்செயல்கள் மேலும் மேலும் அதிகரித்துக் கொண்டிருப்பது மனதுக்கு வேதனையையும் அதிர்ச்சியையும் தருகின்றன என கூறினார் சார்ல்ஸ்.
கற்பழிப்பு, கடத்தல் சம்பவங்கள், சமிக்ஞை விளக்கில் நிற்கும் வாகனங்களின் கண்ணாடிகள் உடைத்தல், திருட்டு, கொலை, கொள்ளை மற்றும் வன்முறை குற்றங்கள் போன்றவற்றை மக்களுக்கு அச்சுறுத்தலையும் பயத்தையும் மிகையாக ஏற்படுத்தியுள்ளன.
அரசியலமைப்பில் பொது மக்களின் பாதுகாப்பை உறுதி செய்வது மத்திய அரசாங்கத்தின் கடமை அதாவது உள்துறை அமைச்சு மற்றும் போலிஸ் காரர்களின் கடமை என குறிப்பிட்டிருந்தாலும் அதை மத்திய அரசாங்கம் சரி வர செய்ய தவறி வருகின்றது என குற்றம் சாட்டிய சார்ல்ஸ், இது வெறும் குற்றச் சாட்டல்ல மாறாக தமது அனுபவம் என அவர் கூறினார்.
சில வாரங்களுக்கு முன்பு, கிள்ளானில் குற்றச் செயல்களை குறைக்க தென் கிள்ளான் மாவட்ட போலிஸ் அதிகாரிகள் சிலர் உட்பட கிள்ளான் நகராண்மைக் கழக உறுப்பினர்கள், குடியிருப்பாளர் சங்கங்கள், ருக்குன் தேதங்கா, அரசு சார இயக்கங்களுடனான கலந்துரையாடலில் முக்கிய சில நடவடிக்கைகள் முன்மொழியப் பட்டன. ஆனால் இதுவரை அவற்றில் எதுவும் செயல் முறைக்கும் நடைமுறைக்கும் கொண்டு வர வில்லை என்பது அவர்களது அலட்சியப் போக்கும் மக்களின் பாதுகாப்பில் போலிஸ் காட்டும் மெத்தனப் போக்கும் குற்றச்செயல்கள் குறிப்பாக கிள்ளான் தொகுதியில் அதிகரித்திருப்பது அம்பலமாகின்றது என்றார் அவர்.
2020 – ல் வளர்சிக் கண்ட நாடாக திகழ வேண்டும் என மலேசியா இலக்குக் கொண்டிருதாலும், தற்போதைய குற்றச் செயல்கள் அதிகரிப்பு அவ்விலக்குக்கு பெருக் முட்டுக் கட்டையே. நிகழ்ந்து வரும் திருட்டு சம்பவங்கள், கொடூர குற்றச் செயல்கள், தானியங்கி பண இயந்திரம் (ஏ டிஎம்) திருட்டு, உயிரைப் பறிக்கும் திருட்டு மற்றும் கொள்ளை சம்பவங்கள், ஆயுத கொள்ளைகள், வாகன திருட்டு போன்ற முறைகேடுகள் நமது மலேசிய நாட்டை பாதுகாப்பான நாடாக சித்தரிக்க கடுகளவுக் கூட முடியாது.
மேலும் ஊடகங்கள் குற்றச்செயல்களை பெரிது படுத்துவதை நிறுத்தச் சொல்வது தலைவிரித்தாடிக் கொண்டிருக்கும் பிரச்சனைக்கு தீர்வாகாது. குற்றச் செயல்கள் நிகழ்வது அனைவருக்கும் சாதக மற்ற செயல். ஆக, இதை தடுக்க நாம் அனைவரும் பாடுபட வேண்டிய அவசியத்தை தெளிவுப் படுத்துகையில், இதனை கருவைக் கொண்டு, தனது சேவை மையம் கூடிய விரைவில் ” குறைசெயல்களை குறைப்பது அனைவரது பொறுப்பு” எனும் பிரசாரத்தை அறிமுகப் படுத்தவுள்ளதாக கூறினார். அதில் குற்றச் செயல்களை தடுக்கும் வழிமுறைகளையும் எடுக்க வேண்டிய நடவடிக்கைகளையும் துண்டு பிரசாரங்களில் அச்சிட்டு விநியோகிக்கப் படும் எனவும் அவர் தெரிவித்தார்.
இம்முயற்சி ஒரு புறம் இருக்க, குற்றச் செயல்களை குறைப்பது மத்திய அரசாங்கத்தின் தலையாய கடமையாகும் என்பதனை மீண்டும் வலியுறுத்திய அவர், ஒரு வேலை போலிஸ் அதிகாரத்தை ஆக்கரமாக பயன்படுத்தி குற்றச் செயல்கள் நிகழ்வதை குறைத்து மலேசிய மக்களுக்கு பாதுகாப்பான சூழ்நிலையை வழங்கும் அளவிற்கு மத்திய அரசாங்கத்திற்கு வலுவில்லாமல் போனால், அது நாட்டை ஆளவே தகுதியற்றது என கடுமையாக சாடினார் சார்ல்ஸ்.

மக்கள் அச்சத்தில் நடமாடுகின்றனர் – மலேசிய பாதுகாப்பான நாடா?? – சார்ல்ஸ் கேள்வி
நாட்டில் குற்றச் செயல்கள் குறைந்துள்ளன. பொது மக்கள் பாதுகாப்பான நிலையில் உள்ளனர் எனும் உள்துறை அமைச்சின் கூற்றும் மறுபக்கம் என்.கே.ஆர்.ஏ குற்றவியல் புள்ளிவிவரங்களும் உண்மைக்கு புறம்பாக உள்ளது என குற்றம் சாட்டினார் கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ.
கடந்த ஆண்டு (2011) ஜனவரி முதல் மே வரையில் 70, 343 குற்றவியல் செயல்களும் இவ்வாண்டு (2012) ஜனவரி முதல் மே வரையில் 63,221 குற்றச்செயல்கள் நிகழ்ந்துள்ளதாக பெமாண்டு வெளியாக்கிய அறிக்கை ஒன்று கூறுகின்றது. அதாவது, கடந்த ஆண்டு (ஜனவரி – மே) காட்டிலும் இவ்வாண்டு மே வரையில் குற்றவியல் செயல்கள் 10.1% குறைந்துள்ளதாகக் கூறும் அதே வேளையில், தெரு குற்றங்கள் 43.0% குறைந்துள்ளதாக அக்குறியீடு கூறுகின்றது.
இது உண்மைக்கு புறம்பானது எனக் கூறிய சார்லஸ், நாட்டில் எத்திசை பார்த்தாலும் குற்றச்செயல் அதிகரித்துக் கொண்டு வருவதையும் பொது மக்கள் அச்சத்தில் நடமாடிக் கொண்டிருக்கின்றனர் எனவும் கூறினார். என்.கே.ஆர்.ஏ -வின் குறியீடு நடைமுறையில் நிகழ்வதை பிரதி பலிக்க தவறி விட்ட வேளையில், ஏன் இந்த குழப்பத்தை மக்களிடையே உள்துறை அமைச்சு ஏற்படுத்துகின்றது என கேள்வி எழுப்பினார்.
நாட்டு மக்களை பாதுகாப்பது அரசாங்கம், காவல் துறை மற்றும் உள்துறை அமைச்சின் தலையாய கடமையாகும். ஆனால் தற்போதைய நிலைமை மிக வேதனைக்குரிய நிலையிலும் அச்சத்திற்குரிய நிலையிலும் உள்ளது. மக்கள் அச்சமின்றி சுதந்திரமாக நடமாட இயலவில்லை என கூறிய சார்ல்ஸ்,மக்களுக்கு அச்சமின்மையான அமைதியான மற்றும் நிம்மதியான சூழ்நிலையை உருவாக்க அரசாங்கம் காவல் துறை, அரசுசார்பற்ற இயக்கங்கள், இதர அரசியல் கட்சிகள்,குடியிருப்பாளர் சங்கம் ஆகியவைகளுடன் ஒன்றிணைந்து காலத்தை கடத்தாமல் நடவடிக்கைகளில் ஈடுபட வேண்டும் என கேட்டுக் கொண்டார்.

Victims of police brutality during the April 28 Bersih rally relate their ordeal of being on the receiving end of ‘karate chops’ and ‘flying kicks’.
KUALA LUMPUR: Mohd. Saufi Othman, 29, was attempting to leave the city on the evening of April 28 when he was confronted by a group of policemen who began raining blows on him.
In the midst of the assault, he felt the barrel of a gun shoved into his chest. The bruise is only just beginning to fade.
Satesh Kumar, 29, was recording the events taking place around the Masjib Jamek LRT station when another group of policemen dragged him away from his mother and girlfriend.
He was kicked and stepped on before being hauled to Dataran Merdeka where the other Bersih detainees were grouped.
Along the way, a traffic policemen stopped him and glanced around before delivering a swift punch to his gut. Satesh was released from Pulapol at 3am the next day.
These were two of the testimonies from the 19 victims of police brutality during the Bersih 3.0 rally last month. Two of the 19 were reporters who decried being beaten up for carrying out their work.
At a press conference here today, the victims spoke of being beaten by unidentified policemen for walking on the streets, recording the on-goings, helping another victim or for simply catching their breath on the sidewalk.
‘Karate chops’ and ‘flying kicks’
“I tried to help my friend who was lying on the road but the policemen who were kicking and punching him turned on me,” said Hanafi Ahmad Zubidin in his 30s. “I had no choice but to run.”
“The police saw me recording them beating people in the Masjib Jamek station and they set upon me too,” recalled Daniel, 39. “I was pushed down a staircase and have five stitches at the back of my right ear,” he added.
But Daniel was luckier than Asrul Wadi, 26, who wound up with nine stitches near his right eye and two more near his left. He has consulted three eye specialists and is facing the possibility of blindness.
Many of those detained had similar stories of being hauled through Dataran Merdeka past two lines of policemen who dealt out punches, “karate chops” and “flying kicks”. Members of PAS’ Unit Amal team who were arrested were reportedly made to walk past the police line twice.
Those who were already in the Black Maria remembered police literally throwing the injured into the trucks and kicking them inside. Some were locked up in back of the trucks for two hours with only a small opening above them for ventilation.
Bersih: Organised pattern
Bersih 3.0 leader Hishamuddin Rais highlighted what he said was an “organised pattern” in the acts of police brutality on that day.
“All the cops who were beating up people wore no name tags or numbers,” he stated. “Groups of them assaulted a single person and they also targetted those with recording devices.”
“There was an organised pattern that day which means that there was a methodology to the brutality. And that means that there were instructions from the top.”
Bersih co-chairperson A Samad Said added that the bulk of assaults had taken place after the rally’s end time of 4pm.
“I am certain there were specific orders for this,” he said, echoing Hishammudin’s allegation. “And we cannot allow such a thing to happen.”
Lack of transparency
The national laureate also read out a press statement by Bersih expressing deep concern over the lack of transparency and information on the status of investigations into the police force as well as the Home Ministry’s failure to provide a press release of the 100 people who have yet to surrender to the authorities.
“Every single day since the Bersih 3.0 rally, fresh allegations of police abuse have surfaced,” Samad read. “Disappointingly to date there has been no substantial action taken by the government to bring to book those responsible for the violence perpetrated by law enforcement officials.”
“Instead police have released images of 141 individuals who are wanted for breaking the law on that day. There appears to be a witch hunt for these individuals instead of seeking out police personnel who committed violence against rally goers.”
On May 9, the police issued a seven-day deadline to the 141 individuals but only 26 have surrendered so far.
Two policemen were charged yesterday for assaulting Guang Ming daily photograper, Wong Kin Onn, but have since pleaded not guilty.
Physical, mental abuse
Samad also pointed out that those who have surrendered to the police had been subjected to physical and mental abuse.
These include Mohd Safuan Mamat 24, who claimed that he had been hit with a metal pipe when he was held overnight after turning up at the police station.
Fadiah Nadwa Fikri of Lawyers for Liberty meanwhile advised those on the list not to go to the police station alone for safety purposes.
“We will accompany you there,” she said. “People are afraid to cooperate with the police after Safuan’s case and the police must give assurance that they will treat people humanely.”
Suaram’s E Nalini added that the police intimidation is not restricted to Peninsular Malaysia but also East Malaysia where students are being threatened by the universities.
“This shows that the issue isn’t over as we are still receiving reports of intimidation to this day,” she said.
Bersih 2.0 has set up a hotline (012-3496013) and an email address (info@bersih.org) for the public to lodge reports of incidents of police brutality on April 28.
The Bersih rally saw some 80,000 people, mostly clad in yellow, taking to the streets demanding free and fair elections.
The peaceful protest turned violent when the barricades at Dataran Merdeka were breached, prompting the police to fire tear gas and water cannons.

Prime Minister Najib Tun Razak croons the country is ready to enter a new era, with heightened maturity – whatever that means is vague because the proposed amendments and dismantling of various laws in Malaysia are merely cosmetic changes.
Malaysia is one of the 16 countries which have not ratified the United Nations Convention on the Elimination of Racial Discrimination (CERD). The country’s institutionalised racial discrimination had contributed to a severe brain drain, with 1.4 million people with tertiary education having left the country.
And yet the government has pulled back plans to table a legislation, in Parliament, to do away with hate crimes and weed out racial discrimination. Mohd Nazri Abdul Aziz, minister in the Prime Minister’s department, attributed this about turn to being able to manage our race relations better.
Last year we saw school teachers and a principal using racial slurs to ridicule Chinese and Indian students. To top that, Malay rights group, Perkasa, was openly inciting racial tension by spewing venom.
The Lesbian, Gay, Bisexual and Transgender (LGBT) community has also come under severe attacks recently. The organisers of Seksualiti Merdeka, an annual festival of talks, shows, forums and film screenings to promote sexuality rights have been targeted, ridiculed and threatened.
In 1994, the government banned anyone who is homosexual, bisexual or transsexual from appearing on the state-controlled media. We have not progressed to curb such explicit hatred against the LGBT community since then.
In 2010, the Film Censorship Board stated it would only allow the depiction of homosexuality if the characters repented or died.
Now we have some segments of society suggesting individuals from the marginalized LGBT community must be banned from appearing on air altogether.
And yet the legislation to root out hate crimes is on the back burner.
‘We want true democracy’
Even though Najib has been trumpeting the fact that he did away with three Emergency Ordinances, we know better as other crucial reforms are simply shadow play.
For example, the Security Offences (Special Measures) Bill is not a radical shift from the draconian Internal Security Act (ISA) which allows for indefinite detention. The new Bill still allows for indefinite detention up to 28 days from the 60 days under the ISA.
If this is what Najib means by revamping the judiciary, he better think again for any indefinite detention poses a grave threat to fundamental liberties. And Human Rights Watch candidly sums this up by saying that the failure to bring a detainee before a judge, without any delay, violates international standards for prompt judicial review.
The Bill also gives wide powers to the police. Holding detainees up to 48 hours opens the channel for abusive interrogation. And we have seen one too many cases of police abuse while in detention. Between 2003-2007, there were 1,535 custodial deaths in the country.
Under the new Bill, the police would have the power to intercept communication and conduct searches without judicial warrant. It would also permit the police to unilaterally place monitoring devices on people who are released from detention and allow a blanket provision to deny bail.
Is this how Najib and his government want to treat a matured society? Does the prime minister truly believe that passing off a proposed law which allows for serious infringement on personal and civil liberties as reform would go unnoticed by the people?
We want true democracy. We want the government to seriously respect our civil and political rights. What we don’t want is the feel good factor.
The renowned poet, Hafiz, said “Not even seven thousand years of joy is worth seven days of depression”. Maybe Najib could learn from his poetry.

Sambil menuntut hak perlembagaan dilindungi, aktivis hak sivil yang diketuai oleh NGO, Kempen Bebas untuk Berhimpun atau Free to Assemble Campaign (FAC) berhimpun di hadapan pintu pagar bangunan Parlimen.
Menghairankan, jumlah polis yang dikerahkan bagi mengawal perhimpunan itu adalah minimum.
“Kami mahu Parlimen tarik balik rang undang-undang yang zalim ini serta-merta kerana ia adalah tidak sah dan menindas.
“Walaupun sekali pandang, permit polis tidak lagi diperlukan, namun sebenarnya, ia mengenakan lebih banyak sekatan lebih tidak munasabah dan memperuntukan denda besar. Ini menjadikannya lebih buruk daripada peruntukan yang sedia ada di bawah Akta Polis,” kata penyelaras Suaram, E Nalini.
Menurutnya lagi, rang undang-undang itu juga bukan setakat menyekat kebabasan awam tetapi juga menghina kebijaksanaan rakyat.
Perhimpunan itu turut disertai oleh pengerusi Gabungan Pilihan Raya Bersih dan Adil (BERSIH 2.0), Datuk Ambiga Sreenevasan dan pemimpin-pemimpin dari Pusat Komunikasi Masyarakat (Komas) dan Rangkaian Rakyat Tertindas (Jerit).
Kira-kira 50 penyokong yang hadir hari ini membawa Jalur Gemilang dan kertas berwarna kuning yang dicetak dengan perkataan “Perkara 10 perlembagaan jamin kebebasan berhimpun”.
“Rang undang-undang ini adalah yang zalim, kami harap ia akan ditarik balik serta-merta … jangan sekalipun percaya ini boleh memberi kebebasan untuk berhimpun,” kata Ambiga.
“Bagi saya rang undang-undang ini merampas kebebasan berhimpun, ia mengambil balik hak yang dijamin oleh perlembagaan,” katanya yang juga bekas pengerusi Majlis Peguam
Menurut Ambiga lagi, rang undang-undang baru itu, lebih teruk daripada Seksyen 27 Akta Polis dan bercanggah dengan jaminan Perdana Menteri Datuk Seri Najib Razak untuk membuat pembaharuan pada malam sebelum Hari Malaysia, 15 September lalu.
