Media Statement by Democratic Action Party (DAP) Members of Parliament in Selangor, on 26 December 2009:

We urge the police to tackle crime with the same vigour they are putting in to intimidate and persecute Pakatan Rakyat leaders.

The move to investigate Penang Chief Minister and DAP secretary-general Lim Guan Eng for allegedly making seditious remarks during the Pakatan Rakyat convention in Shah Alam last weekend was of misguided priority as the public lives in fear as violent crimes are being committed every day.

Guan Eng’s statement cannot be deemed as unsubstantiated remarks as he was only echoing the conclusion of the acclaimed Thai forensic pathologist Dr Porntip Rojanasunan, who attended the second post mortem on Teoh Beng Hock last month as an observer, that there was an 80% possibility of homicide in Beng Hock’s death.

We want to remind Selangor police chief Datuk Khalid Abu Bakar that Guan Eng was only repeating what millions of people in the country and the world are saying.

If Guan Eng’s statement that Beng Hock had been cruelly murdered is “unsubstantiated” and need to be investigated under Sedition Act, then why the police did not initiate sedition investigation against Datuk Seri Nazri Abdul Aziz who said Beng Hock “nak terjun bangunan itu” and Malaysian Anti-Corruption Commission Chief Commissioner Datuk Seri Ahmad Said who said Beng Hock had committed suicide? Are they statements substantiated by any solid facts?

PDRM should be putting more resources into tackling real rather than imaginary criminals.

The discovery of the body on Wednesday of yet another child believed to have been sexually violated before being murdered is a chilling reminder we need more frontline police officers and not pen-pushers.

Words don’t kill; killers do. Datuk Khalid Abu Bakar need to be reminded that PDRM should take care of the interest of rakyat, not the interest of MACC and/or BN.

民主行动党雪州国会议员于2009年12月26日在八打灵再也发表的联合文告:

纳兹力和阿末赛益说明福自杀没事;林冠英为何不能附和普缇的讲法?

雪州总警长卡立表示要援引煽动法令对付发表明福被杀言论的槟城首长林冠英,我们对此表达强烈抗议。

林冠英只是附和泰国法医普缇在日前提出的“明福是80%被杀”的结论,同时也没有任何迹象显示林冠英发表了这项言论后人民情绪被煽动,反倒是卡立杞人忧天,竟然自己去报案指控林冠英,政治动机非常明显。

其实打自明福坠楼事件发生以来,警方就一直是以自杀的角度展开调查,完全不肯正视明福是有惨遭他杀的可能性。直到普缇在验尸庭上供证,指出明福确实是有80% 的可能性是被他杀。民主行动党在普缇做出明福是有可能遭到他杀的结论后,曾经到警局报案,要求警方不能只以自杀的角度来调查明福案件,更应该以他杀的角度来调查,然而警方至今却没有任何的行动,让人民失望不已。

我们要提醒卡立,不只是林冠英附和普缇的结论,大部分人民也对普缇的结论也是深信不疑。警察应该是人民的保姆,而不是反贪会或者国阵的保姆。

我们也要质问卡立,如果林冠英发表明福他杀的言论需要被调查,为何警方又对纳兹里在明福死后所发表的“我怎知道他会跳楼”的言论以及反贪污委员会主席阿末赛益把赵明福的死因,归咎于承受不了调查压力而自杀的言论视若无睹呢?难道纳兹里和阿末赛益的言论就是属于有根有据?

因此,我们要求雪州警方即刻撤销对林冠英的指控,并以公正和专业的角度处理明福案件,好让案件水落石出。

SHAH ALAM – The Selangor government is concerned with the findings  of Thai pathologist Dr Pornthip Rojanasunand regarding the death of political aide Teoh Beng Hock.

Mentri Besar Khalid Ibrahim said Thursday her evidence proved that the state’s fear on the safety of its government officials during interrogation by the Malaysian Anti-Corruption Commission (MACC) is not totally unfounded.

Dr Porntip, khalid-ibrahim.pngwho testified on Wednesday at the inquest into Teoh’s death, had said that there is an 80% probability that Teoh’s death was homicide, and 20% suicide.

She also suggested that the late political secretary to state executive councilor Ean Yong could have been strangled before falling from the 14th floor of the Plaza Masalam building here.

Teoh, 30, was found dead on the 5th floor of the building on July 16, a day

after he was questioned by MACC over alleged misuse of state funds by state executive councilors.

Head injuries caused by blunt object

Dr Pornthip also testified that Teoh’s  head injuries was the result of blunt force applied directly to the skull  and  could have been strangled.

She also said that Teoh was alive but unconscious when he hit the roof where his body was found. According to Dr Pornthip, the tear in Teoh’s anus was caused by an object forcefully inserted into him.

“We hope the relevant authorities will stury Dr Porntip’s evidence objectively to ensure that justice is served,” Khalid said Thursday.

“Given her experience in investigating complicated homicide and having performed more than 10,000 autopsies in the last 27 years, dr porntip’s evidence cannot be taken lightly,” he added.

The state government reiterate its call for a Royal Commission of Inquiry into Teoh’s death instead of just looking into the interrogation methods used on him by the MACC.

Suspend those who interrogated Teoh

Meanwhile, Klang MP Charles Santiago has also called for the immediate suspension of all anti-graft officers involved in interrogating Teoh as well as a Royal Commission of Inquiry to independently investigate the circumstances leading to Teoh’s death.

“It is extrcharles-santiago-2.pngemely disturbing to read about Dr Pornthip’s findings relating to Teoh’s death,” he said.

Santiago said Dr Pornthip’s findings question the credibility of two previous pathologists, Khairul Aznam Ibrahim from the Tengku Ampuan Rahimah Hospital, Klang,and Prashant Naresh Samberkar, from the University Malaya Medical Centre, Kuala Lumpur. They both had said Teoh committed suicide.

“Were the testimonies of Khairul and Prashant nipped and tucked to protect the anti-corruption officers responsible for Teoh’s death?” he asked. “Or they could have testified under duress.”

“It is clear that the MACC was used as a tool by the Umno-led government to intimidate the opposition.

“Prime Minister Najib Abdul Razak made it clear that he would wrestle Selangor back from the Pakatan Rakyat government. And in the process a young man is dead,” he alleged.

More than just Dr Porntip’s observations

“There may be more to this tale than Dr Porntip’s observations – in the form of an anonymous letter in Malay, on MACC stationery, accusing top anti-graft officer Hishamuddin Hashim of conspiring with former Selangor menteri besar Mohamad Khir Toyo to conduct corruption enquiries into opposition politicians.

“Clearly the upper echelon officers of MACC worked in cohorts to tarnish the credibility of Pakatan Rakyat politicians and topple the Selangor government.”

Santiago said Dr Pornthip’s findings completely eroded the confidence in the anti-corruption agency.

He alleged said this was not the first time that the ruling Barisan Nasional government is trying to ignore deaths in custody.

He cited the case of  A Kugan Ananthan, which drew outrage when a video of his badly injured body surfaced. He died in police custody and his body bore severe lacerations, wounds and burn marks.

A policeman has been charged after eight months despite the multiple injuries sustained by Kugan, raised speculations that many more policemen were involved..

The policeman was charged with causing grievous hurt to Kugan to extort a confession, although the Attorney-General had earlier classified the case as murder.

According to statistics revealed in Parliament last year, there were a total of 1,535 custodial deaths in the country between 2003 and 2007.

Testimoni Pakar Patologi Thailand Dr. Porntip Rojanasunan di inkues memeranjatkan, kesimpulan beliau bahawa Beng Hock mungkin dibunuh telah menggegarkan kredibiliti terhadap Suruhanjaya Pencegahan Rasuah Malaysia (SPRM).

Dr. Porntip memberitahu inkues kecederaan pada tempurung kepala Beng Hock berkemungkinan disebabkan pukulan dengan objek tumpul dan kesan lebam di lehernya bermungkinan disebabkan cekikan.

Beliau berkata Beng Hock masih hidup apabila mendarat jatuh, Beng Hock berkemungkinan tidak sedar diri sewaktu jatuh. Menurutnya, kecederaan di bahagian dubur boleh disebabkan tusukan objek.

Perjumpaan Dr. Porntip menyoalkan kredibiliti dua orang patologi sebelum ini, iaitu Khairul Aznam Ibrahim dari  hospital Tengku Ampuan Rahimah di Klang dan Prashant Naresh Samberkar dari Pusat Perubatan Universiti Malaya di Kuala Lumpur. Mereka berkata Beng Hock mati bunuh diri.

Adakah Khairul dan Prashant terpaksa membuat laporan palsu untuk melindungi pegawai-pegawai yang terlibat dalam kematian Beng Hock? Ataupun mereka menyediakan laporan dibawah tekanan?

Ini jelas menunjukkan SPRM ialah alat kerajaan yang dipimpin oleh UMNO untuk menakutkan parti pembangkang. Perdana Menteri Najib Tun Razak telah memberi arahan jelas untuk merampas balik kerajaan Selangor. Dalam proses ini seorang pemuda mati.

Malahan semakin misteri ialah satu pucuk surat dengan letterhead SPRM menuduh Timbalan Pengarah SPRM Selangor Hishammudin Hashim dan bekas Menteri Besar Selangor Khir Toyo merancangkan konspirasi bagi menyiasat tuduhan-tuduhan rasuah wakil rakyat pakatan rakyat.

Pimpinan SPRM dan Khir Toyo mahu mencemarkan kredibiliti wakil rakyat pakatan rakyat dan menumbangkan kerajaan selangor. Sebaliknya, perjumpaan Dr. Porntip menyebabkan orang awam hilang segala keyakinan terhadap SPRM.

Ini bukan kali pertama kerajaan Barisan Nasional mengabaikan kematian dalam lokap, perkara ini tidak pernah dipantau dan dibetulkan. Kematian Kugan menyebabkan kemarahan orang awam kerana satu video menunjukkan kecederaan di badan beliau. Kugan mati di dalam lokap polis, badan beliau mempunyai kecederaan dalam dan panjang serta terbakar.

Selepas 8 bulan, hanya seorang anggota polis didakwa. Kecederaan di atas badan Kugan adalah terlalu banyak, ini membangkitkan pertanyaan lebih banyak anggota polis terlibat. Anggota polis ini hanya didakwa telah dengan sengaja menyebabkan cedera parah kepada Kugan untuk medapat perakuan, walaupun peguam Negara telah mengklasifikasikan kes ini sebagai pembunuhan.

Menurut statistik parlimen tahun lepas, di antara 2003 hingga 2007, terdapat 1535 kes kematian dalam lokap.

Jika kerajaan terus melindungi pengganas ini untuk mencapai agenda politik Barisan Nasional, Malaysia akan menghadapi krisis keyakinin terbesar.

Dengan ini, saya menggesa kerajaan gantung pegawai-pegawai yang terlibat dalam temubual Beng Hock serta merta. Saya juga menggesa kerajaan menubuhkan suruhanjaya diraja untuk menyiasat secara bebas kematian Beng Hock.

Perjumpaan Dr. Porntip mengenai kematian Beng Hock amat menyakiti hati, dengan ini saya menawarkan simpati terdalam saya kepada ibubapa, isteri, ahli keluarga dan kawan Beng Hock.

停职查办明福调查官,成立皇家调查委员会

泰国著名法医普缇在赵明福死因调查庭上的供证令人震惊。她的结论是赵明福或被他杀,这已强烈动摇反贪委员会的可信度。

普缇博士的供证显示赵明福的头盖骨裂痕是由硬物敲击所致及怀疑曾遭人掐着喉咙。

她说赵明福撞上五楼屋顶时仍活着,但已失去意识。根据普缇医生,赵明福的肛门裂痕是硬物插入所致。

普缇的发现质疑前两位法医的诚信,他们是来自巴生中央医院的凯鲁阿兹南和来自吉隆坡马大医药中心的巴拉山那勒斯。他们都说赵明福死于自杀。

凯鲁和巴拉山是否被逼捏造证词以庇护致死赵明福的官员?或者他们是在压力下供证?

这清楚显示反贪委员会是巫统领导的政府用来恐吓反对党的工具。首相纳吉已清楚指示要巫统夺回雪州政府。在这个过程中一个年轻人因此死亡。

比普缇的供证更离奇的是,一封以反贪委员会信头发出的匿名信指责雪州反贪委员会副总监希山慕丁哈欣和前雪州大臣莫哈末基尔多约串谋调查民联议员涉贪事件。

反贪委员会高层和基尔企图抹黑民联议员的诚信以及推翻雪州政府。相反的,普缇的发现导致公众丧失对反贪委员会的所有信心。

这不是国阵政府第一次漠视扣留所死亡,这个滥权现象一直没有被监督和被纠正。古甘之死引起众怒,一个影片曝露了他身上的严重伤痕。他死于警察扣留所,身体上有深刻的伤口和被烧伤的伤痕。

八个月后,仅有一个警员被控。古甘身上的伤痕委实太多,这令人怀疑更多警员涉及。该名警员只是被控严重致伤古甘以逼他认罪,虽然总检察长已把此案列为谋杀处理。

根据去年国会提出的数据,2003年至2007年之间,扣留所死亡共达1535宗。

如果政府继续庇护这些滥权施暴者以遂国阵的政治议程,马来西亚将面对最大的信心危机。

因此,我促请政府马上把涉及盘问赵明福的官员停职。我也促请政府即刻成立皇家调查委员会以独立调查赵明福的死因。

普缇关于赵明福之死的发现令人难受,我谨此向赵明福的父母、妻子、家属和朋友表达我最深的同情和哀悼。

Dr Pornthip also testified that Teoh’s  head injuries was the result of blunt force applied directly to the skull  and  could have been strangled.

Dr Pornthip’s findings question the credibility of the previous two pathologists, Khairul Aznam Ibrahim from the Hospital Tengku Ampuan Rahimah in Klang and Prashant Naresh Samberkar from the University Malaya Medical Centre in Kuala Lumpur. They both said Teoh had committed suicide.

Were the testimonies of Khairul and Prashant  nipped and tucked to protect the anti-corruption officers responsible for Teoh’s death. Or they could have testified under duress.

This is not the first time that the ruling BN government is trying to ignore deaths in custody that obstinately persist due to abuse of power that have been largely left unchecked.

One police officer has been charged after eight months despite the multiple injuries sustained by Kugan, raising doubt that many more policemen were involved. And the police officer was charged with causing grievous hurt to Kugan to extort a confession, although the Attorney-General had earlier classified the case as murder.

According to statistics revealed in Parliament last year, there were a total of 1535 custodial deaths in the country between 2003-2007.

If the government continues to shield and protect the perpetrators of abuse to fulfil its own political agenda, Malaysia will suffer its greatest crisis of confidence.

As such I call for the immediate suspension of all the anti-graft officers involved in interrogating Teoh. I also call upon the government to set-up a Royal Commission of Enquiry to independently investigate the circumstances leading to Teoh’s death.

It is extremely disturbing to read about Dr Pornthip’s findings relating to Teoh’s death. I, therefore, offer my deepest sympathy to Teoh’s parents, fiance, family and friends.

Seluruh badan beliau dipukul dan tempat kemaluan beliau disebat oleh satu rod besi yang digulung oleh surat khabar. “Ketika itu, saya hanya pakai seluar dalam dan tangan saya digari di belakang. I juga ditendang dan dipukul seluruh badan oleh lebih kurang 10 hingga 15 orang.”

Ini bukan kali pertama kita mendengar aduan penganiayaan dalam tahanan. Kali ini mangsa ialah T Sivanesan, beliau dibawa ke pejabat Suruhanjaya Pencegahan Rasuah Malaysia di Shah Alam untuk membantu dalam siasatan.

Teoh Beng Hock, setiausaha politik kepada Ahli Majlis Mesyuarat Kerajaan Selangor Ean Yong Hian Wah mati di bangunan Masalam, ibu pejabat Suruhanjaya Pencegahan Rasuah Selangor. Beliau adalah seorang saksi dalam siasatan.

Kedua-dua Teoh dan Sivanesan ditanya oleh pegawai SPRM Mohd Ashraf Mohd Yunus. Testimoni Sivanesan bukan sahaja menimbul soalan adakah kaedah pertanyaan yang digunakan oleh SPRM mematuhi undang-undang, ia juga menunjukkan ada kemungkinan penganiayaan fizikal dan mental tersebut dialami oleh Teoh.

Kerajaan selalu  beritahu rakyat percayailah SPRM dan badan-badan penguatkuasa lain. Tetapi saya bersama dengan rakyat Malaysia lain berpendapat kenyataan itu terlalu rapuh. 

Tragedi yang terjadi kepada Teoh menunjukkan pegawai SPRM telah menerima arahan untuk menumbangkan kerajaan pakatan negeri Selangor, kenyataan Sivanesan yang mengejutkan menunjukkan penganiayaan merupakan sebahagian siasatan dalam institusi penguatkuasa Malaysia.

Suruhanjaya Hak Asasi Manusia Malaysia (Suhakam) mendiamkan diri selepas menerima laporan Penganiayaan Sivanesan. Penjelasan pengerusi Suhakam Tan Sri Abu Talib Othman ialah suruhanjaya tersebut tidak ada kuasa mengambil tindakan dan tidak boleh beroperasi membatasi undang-undang, kenyataan ini adalah tidak masuk akal.

Suhakam bukan sahaja menghiraukan kes Sivanesan tetapi juga gagal memperjuangkan hak asasi manusia di Malaysia.

Malaysia telah menjadi satu teater untuk masa manusia tergelap dengan pembunuhan diluar undang-undang, peningkatan nombor kematian dalam lokap, peningkatan kadar jenayah, rasuah berleluasa dan perhubungan kaum semakin tegang.

Oleh itu, saya menggesa kerajaan yang dipimpin oleh UMNO dan Perdana Menteri Datuk Seri Najib Tun Razak menubuhkan satu pasukan siasatan  khas untuk menyiasat secara bebas aduan Sivanesan dan mendakwa sesiapa yang bertanggungjawab ke atas penganiayaan beliau semasa dalam lokap. Sebelum siasatan khas ini dilakukan, semua pegawai yang terlibat dalam pertanyaan Sivanesan harus digantung serta merta.

调查反贪委员会及惩罚在扣留所虐待西华尼申的官员

他全身都被殴打,他的性器官被一支用报纸包住的铁棒鞭打。“那时候,我只穿着内裤,双手被反扣。我同时被10至15人殴打全身。”

这并非第一次我们听到扣留所虐待事件。这次的受害者是西华尼申,他被带去莎阿南反贪委员会办公室协助调查。

两个月前,雪州行政议员欧阳捍华的助理赵明福在同样地点离奇死亡,他是一起调查案件的证人。

赵明福和西华尼申都曾被反贪委员会官员莫哈末阿斯拉夫莫哈末尤努斯拷问。西华尼申的证词不但质疑反贪委员会使用的盘问方法的合法性,也显示赵明福可能同样遭到生理和心理虐待。

联邦政府不断呼吁人民相信反贪委员会和其它执法机构。但我一如其他大马人,觉得这个政治说辞不值一信也不堪一击。

赵明福的悲剧突显反贪委员会官员如何阿谀奉承他们的政治主子,接受命令参与推翻雪州民联政府的计划。西华尼申的证词指出虐待是大马执法机构的盘问手段的一部分。

更令人震惊的是西华尼申曾向人权委员会投报被反贪委员会官员虐待,但是人权委员会作为维护人权的国家机构,竟然对西华尼申的投报保持沉默。人权委员会主席丹斯里阿布达立辩解,人权委员会没有实权及不能超越人权委员会法令赋予的权限,这是荒谬可笑的。

人权委员会不但漠视西华尼申的投诉,在大多数时间里,它也无法维护和争取国民的人权。

马来西亚已成了人类黑暗时刻的剧场 — 违法的杀戳、不断增加的扣留所死亡数目、毫无对策节节上升的犯罪率,猖獗的贪污和种族关系日趋紧张。

职是之故,我强烈促请巫统领导的联邦政府和拿督斯里纳吉拉萨即刻成立一个特别调查团,针对西华尼申投诉扣留所虐待展开独立的调查。在调查展开之前,政府有必要把所有涉及拷问西华尼申的官员马上停职处分,直到调查完成。

The Malaysian drama unfolding the last few days surrounding the death of Teoh Beng Hock suggests that race-relations in the country are at its lowest point ever.

Various quarters have turned this sad episode into a race issue.

The New Straits Times recently suggested that MACC is a Malay institution and asked as to why the Selangor MB, a Malay, was questioning fellow Malays and MACC, a Malay institution.

Minister Mohamed Nazri Abdul Aziz told DAP veteran leader Lim Kit Siang not to politicise Teoh’s death and turn it into a race issue.

A couple of days ago, UMNO members demonstrated in support of MACC and the police and indicated that they would respond if the opposition further politicises Teoh’s death.

Mahathir, not to be out-done, indicated that Malaysia has been taken over by non-Malays. In fact, the former Prime Minister pointedly noted that the Chinese are the masters in the Malay land.

Taken together, criticisms against the police and MACC are perceived as an attack on Malays and Malay institutions. In fact, it is seen as an attack on Malay political hegemony of the country, ( and note that the economy has been lost to the Chinese). And according to UMNO protestor’s response can be expected if the situation persists.

Why is the country being held hostage by UMNO Malays?

We are aware of the numerous deaths in custody cases involving all races. On the very same day when Teoh was found sprawled in the building that houses MACC, another young Malaysian died in police custody in a different part of the country. And what about the thousands of Malaysians that have died in police custody in the last couple of years.

An unaccountable and non-transparent police force and MACC is a threat to all Malaysians, both Malays and non-Malays.  In fact even UMNO members may fall prey to these very agencies. About six-months ago UMNO member Halimi Kamaruzzman was tortured in the Pahang MACC head office.

Both these institutions have become a source of divisiveness, distrust and ridicule among the population.

MACC and the PDRM are Malaysian institutions. They are public bodies entrusted with specific mandates to protect and promote the interests of the nation and its people. The agencies are paid by the country’s tax payers and are thus accountable to all Malaysians.

These agencies require fundamental reform. The use of race to prevent criticism, cover-up of custodial deaths, change and institutional reform are the indications of a failing state.

And worse still, both these state agencies have been given a new mandate: destabilise Pakatan Rakyat (and thus the botched episode involving Teoh).

How is Najib, consistent with his 1Malaysia going to convince his party-men and women including the New Straits Times and his Minister, Nazri that the police and MACC are Malaysian organisations representing all Malaysians regardless of affiliations?

More importantly, how is he going to convince fellow Malaysians that he is the Prime Minister of all Malaysians and not only UMNO Malays?

The Prime Minister has to do three things:

1.  to openly state that the police and MACC are not part of UMNOs strategy to bring down    the Pakatan Rakyat government. In fact this should be part of the scope of the Royal Commission’s investigations;

2. to put in place policies that ensures that the police and MACC are independent of UMNO and its ministers in government. Here the IPCMC recommendations would be helpful;

3) to instruct MACC, NAZRI and NST to offer an unreserved apology to Teoh’s family on their offensive and racist remarks;

4) to include the cause(s) of Teoh’s death as part of the Royal Commission’s investigations.

Rawang state assemblyperson Gan Pei Nei and three Pakatan Rakyat political aides have handed a memorandum to the Human Rights Commission (Suhakam), over alleged manhandling by the police.

This was alleged to have happened last Friday during a protest at the Selangor MACC office in Plaza Masalam, Shah Alam, against the death of political aide Teoh Beng Hock.

Today, the four provided details to Commissioner N Siva Subramaniam at the Suhakam headquarters in Kuala Lumpur.

Gan was accompanied by Loo Chuan Boon (an aide to Bukit Lanjan state assemblyperson Elizabeth Wong), Ng Yap Hwa (an aide to Klang MP Charles Santiago) and Sarah Vanitha Devaraj (another aide to Santiago).

Footage from four videos and still images lasting eight minutes were projected on a wide screen to back their claim. A copy of the footage, recorded by several people, was handed over.

The memorandum said about 300 people had gathered demanding action from the MACC.

Police began dispersing the crowd after 40 minutes and a melee broke out.

Gan, who was the final speaker that day, said the melee broke out when a man tried to grab the loud-hailer from her.

“They were in plainclothes, no ID, no idea if they are the police,” she said.

“The men dragged me, I am a woman. (While this was going on) the FRU were surrounding us. There was pushing and then I knocked my head on the ground.”

Loo said “they could have easily been gangsters for all we know”.

Five demands made

The memorandum contains five demands – an inquiry into the incident; respect for human rights; monitoring by Suhakam of future peaceful assemblies; mediation with the police when there is violation of the right to assemble; and the repeal of discriminatory laws.

Only Ng has lodged a police report on the incident.

Loo said that he was dragged 30 metres before he was handcuffed and that this left marks on his wrists.

“I told the police ‘I am not guilty why are you handcuffing me?’ The police replied that I was being taken for questioning,” he said.

Loo added that the police removed the handcuffs only when Wong informed them that he was a member of her staff.

Siva said the matter will be discussed at the commission meeting on Aug 10.

“Suhakam has stressed many times that the fundamental right to hold peaceful assemblies should be guaranteed, and all laws that restrict freedom of expression and assembly should be repealed,” he said.

“We will ask for more details from the authorities as we need to listen to their side of the story as well.

“I assure you that the fundamental rights of an individual to do something within the scope of the federal constitution will always be upheld.”

Suhakam siasat kematian Beng Hock

KUALA LUMPUR – Suruhanjaya Hak Asasi Manusia Malaysia (Suhakam) akan menyiasat dengan terperinci kematian setiausaha politik Exco kerajaan negeri Selangor, Teoh Beng Hock Khamis lepas, kata Pesuruhjayanya Datuk N. Siva Subramaniam.

Beliau berkata siasatan itu meliputi dakwaan beberapa individu yang mereka dicederakan anggota polis ketika berdemonstrasi Jumaat lepas di hadapan Plaza Masalam di mana Teoh dijumpai mati tertiarap.

“Suhakam akan menjalankan siasatan bebas terhadap kedua-dua kejadian ini dan segala keputusan sama ada inkuiri awam dibuat akan diketahui selepas mesyuarat kami diadakan bulan hadapan,” katanya.

Beliau berkata demikian kepada pemberita selepas menerima memorandum bantahan daripada beberapa individu yang mendakwa dicederakan polis semasa demonstrasi berkenaan di pejabat suruhanjaya itu di sini hari ini.

Siva berkata hak asasi orang awam perlu dikekalkan dan dipatuhi ketika penyiasatan dilakukan mana mana badan atau pihak berkuasa dan agensi berkaitan.

Menurut Konvensyen Terhadap Penderaan dan Kekejaman Lain, Tidak Berperikemanusiaan atau Layanan Buruk atau Hukuman, penderaan membabitkan apa-apa tindakan dikenakan terhadap seseorang bagi mendapatkan daripadanya atau orang ketiga maklumat atau keterangan dengan izin atau persetujuan daripada seorang pegawai awam atau individu lain yang bertindak dalam kapasiti rasminya.

Teoh, 30, ditemui mati pada pukul 1.30 tengah hari Khamis lepas di koridor luar tingkat lima bangunan Plaza Masalam di Shah Alam yang turut menempatkan pejabat SPRM Selangor di Tingkat 14.

Teoh, yang merupakan setiausaha politik kepada Ean Yong Hian Wah, Anggota Dewan Undangan Negeri Seri Kembangan, merupakan seorang daripada saksi dalam siasatan SPRM berhubung dakwaan penyalahgunaan peruntukan negeri baru-baru ini.- Bernama

为明福伸冤集会惨遭暴力镇压
颜贝倪及一女助理控诉性骚扰

公正党万挠州议员颜贝倪和一批民联议员的助理,今日向大马人权委员会投诉,他们上周出席雪州反贪污委员会总部前,为同僚赵明福伸冤的和平集会时,惨遭警方暴力镇压。

在混乱中头部遭致伤的颜贝倪(左图左二)以及行动党巴生国会议员查尔斯女助理莎拉(Sarah Vanitha Devaraj),更控诉惨遭男警员的性骚扰。

今早一起到人权委员会办公室提呈备忘录的人士包括,在集会中遭致伤入院接受治疗的颜贝倪和公正党雪州行政议员黄洁冰的助理卢传文,被逮捕的公正党灵南区国会议员许来贤的助理骆文吉(左图中)和查尔斯的另一名助理黄业华,以及雪隆公正队执行长李凯伦等一行人。

他们在备忘录中,抨击警方当天的行径等同侵犯基本人权,并希望人权委员会能够召开公开听证会,彻查此事。

西华认同有权和平集会表态

人权委员会委员西华在接收备忘录时,也认同集会者的确有权举行和平集会,来表达他们对赵明福离奇坠楼事件的感受。

他表示,该委员会将交由投诉和调查小组展开初步调查,包括向警方索取详情,然后才在8月10日召开的会议中,决定是否要召开听证会。

300名民联支持者及许多雪州民联议员的助理是在上周五于雪州反贪会总部所在的沙亚南商业广场示威,要求针对赵明福案调查反贪会。

不料却遭警方出动镇暴队强力驱散,并逮捕了7人包括雪州加埔国会议员马尼卡 、雪州行政议员西维尔以及数名政治助理。在冲突过程中,卢传文和颜贝倪(上图中)也被致伤而入院。

颜贝倪和助理遭男警员推挤

颜贝倪(左图)在提呈备忘录时指出,她当时是集会的最后一名演讲者,结果却遭到一些身穿便衣的不明男性的拉扯,及抢走其手中的扩音器。她认为,这些男性的举动构成性骚扰。

“那些拉我的人都是男性官员,这让身为女性人民代议士的我,觉得受到骚扰。”

她也指责,镇暴队队员那时包围在其身后和大力推挤,结果导致她跌倒在地上和敲到头,额头出现淤青,必须送院接受治疗。

“我身为人民代议士都已经受到警方的粗暴对付,我无法想象普通人民将会面对怎样的对待。”

由于莎拉今早不克出席,其同僚黄业华则代为投诉说,她遭到男性警员的手推脚踢,甚至推她的上身,因此已经构成性骚扰。

昏晕却仍遭警员在地上强拖

卢传文和黄业华也向西华投诉,警方在试图逮捕他们时行使暴力,甚至在他们近乎昏晕的情况下,警员仍然在地上强行拖走。

卢传文声称,他在试图阻止警方逮捕颜贝倪时,遭到数名便衣警员强行拖走多达30米,随后就跌到在地上,而警员也使用手铐铐住他的手。

他表示,虽然他当时坚持和平集会没错而无需铐手,并多次投诉感到脚痛,但是警方还是强行拖走他,甚至用脚踩在其身上,结果他第二次跌到在地。

“尽管黄洁冰上前表明我是其雇员,并尝试和警方谈判,但是他们还是不理睬,继续强行拉扯手铐,直到我手上充满红色伤痕后才愿意释放我。”

卢传文指出,朋友将他带往其他地方休息,而他随后才清醒过来,发现自己处在沙亚南广场里面。

他随后也被送往巴生医院治疗。

播录影短片证明警暴力驱散

黄业华(右图)则控诉,他是在尝试救出卢传文时遭警方捉住。

“尽管我尝试挣扎及近乎昏晕,但是警员还是强行将我拖行长达50米”。

他表示,直到莎拉前来协助后,他才成功脱难。

颜贝倪等5人在较早时也播放4个录影短片,证明警方的确行使暴力来驱散集会者。其中,镜头可以清楚看到数名便衣警员在地上拖走卢传文,以及有一只脚踩在卢传文身上。

他们也在备忘录中向人权委员会提出另外4项要求,分别是确保警方尊重宪法赋予的人权、在集会现场发生警方侵犯人权时就率先干涉、施压政府废除限制集会和言论自由的法律,以及施压政府成立警察投诉和滥权独立委员会(IPCMC)。

黄业华更向西华施压说,人权委员会必须认真看待他们的投诉。他表示,他们也会提呈这份备忘录给负责监督人权委员会表现的国际协调委员会(ICC),并希望人权委员会能够继续保住A等的评级。
