Rawang state assemblyperson Gan Pei Nei and three Pakatan Rakyat political aides have handed a memorandum to the Human Rights Commission (Suhakam), over alleged manhandling by the police.
This was alleged to have happened last Friday during a protest at the Selangor MACC office in Plaza Masalam, Shah Alam, against the death of political aide Teoh Beng Hock.
Today, the four provided details to Commissioner N Siva Subramaniam at the Suhakam headquarters in Kuala Lumpur.
Gan was accompanied by Loo Chuan Boon (an aide to Bukit Lanjan state assemblyperson Elizabeth Wong), Ng Yap Hwa (an aide to Klang MP Charles Santiago) and Sarah Vanitha Devaraj (another aide to Santiago).
Footage from four videos and still images lasting eight minutes were projected on a wide screen to back their claim. A copy of the footage, recorded by several people, was handed over.
The memorandum said about 300 people had gathered demanding action from the MACC.
Police began dispersing the crowd after 40 minutes and a melee broke out.
Gan, who was the final speaker that day, said the melee broke out when a man tried to grab the loud-hailer from her.
“They were in plainclothes, no ID, no idea if they are the police,” she said.
“The men dragged me, I am a woman. (While this was going on) the FRU were surrounding us. There was pushing and then I knocked my head on the ground.”
Loo said “they could have easily been gangsters for all we know”.
Five demands made
The memorandum contains five demands – an inquiry into the incident; respect for human rights; monitoring by Suhakam of future peaceful assemblies; mediation with the police when there is violation of the right to assemble; and the repeal of discriminatory laws.
Only Ng has lodged a police report on the incident.
Loo said that he was dragged 30 metres before he was handcuffed and that this left marks on his wrists.
“I told the police ‘I am not guilty why are you handcuffing me?’ The police replied that I was being taken for questioning,” he said.
Loo added that the police removed the handcuffs only when Wong informed them that he was a member of her staff.
Siva said the matter will be discussed at the commission meeting on Aug 10.
“Suhakam has stressed many times that the fundamental right to hold peaceful assemblies should be guaranteed, and all laws that restrict freedom of expression and assembly should be repealed,” he said.
“We will ask for more details from the authorities as we need to listen to their side of the story as well.
“I assure you that the fundamental rights of an individual to do something within the scope of the federal constitution will always be upheld.”

Suhakam siasat kematian Beng Hock
KUALA LUMPUR – Suruhanjaya Hak Asasi Manusia Malaysia (Suhakam) akan menyiasat dengan terperinci kematian setiausaha politik Exco kerajaan negeri Selangor, Teoh Beng Hock Khamis lepas, kata Pesuruhjayanya Datuk N. Siva Subramaniam.
Beliau berkata siasatan itu meliputi dakwaan beberapa individu yang mereka dicederakan anggota polis ketika berdemonstrasi Jumaat lepas di hadapan Plaza Masalam di mana Teoh dijumpai mati tertiarap.
“Suhakam akan menjalankan siasatan bebas terhadap kedua-dua kejadian ini dan segala keputusan sama ada inkuiri awam dibuat akan diketahui selepas mesyuarat kami diadakan bulan hadapan,” katanya.
Beliau berkata demikian kepada pemberita selepas menerima memorandum bantahan daripada beberapa individu yang mendakwa dicederakan polis semasa demonstrasi berkenaan di pejabat suruhanjaya itu di sini hari ini.
Siva berkata hak asasi orang awam perlu dikekalkan dan dipatuhi ketika penyiasatan dilakukan mana mana badan atau pihak berkuasa dan agensi berkaitan.
Menurut Konvensyen Terhadap Penderaan dan Kekejaman Lain, Tidak Berperikemanusiaan atau Layanan Buruk atau Hukuman, penderaan membabitkan apa-apa tindakan dikenakan terhadap seseorang bagi mendapatkan daripadanya atau orang ketiga maklumat atau keterangan dengan izin atau persetujuan daripada seorang pegawai awam atau individu lain yang bertindak dalam kapasiti rasminya.
Teoh, 30, ditemui mati pada pukul 1.30 tengah hari Khamis lepas di koridor luar tingkat lima bangunan Plaza Masalam di Shah Alam yang turut menempatkan pejabat SPRM Selangor di Tingkat 14.
Teoh, yang merupakan setiausaha politik kepada Ean Yong Hian Wah, Anggota Dewan Undangan Negeri Seri Kembangan, merupakan seorang daripada saksi dalam siasatan SPRM berhubung dakwaan penyalahgunaan peruntukan negeri baru-baru ini.- Bernama

为明福伸冤集会惨遭暴力镇压
颜贝倪及一女助理控诉性骚扰

公正党万挠州议员颜贝倪和一批民联议员的助理,今日向大马人权委员会投诉,他们上周出席雪州反贪污委员会总部前,为同僚赵明福伸冤的和平集会时,惨遭警方暴力镇压。
在混乱中头部遭致伤的颜贝倪(左图左二)以及行动党巴生国会议员查尔斯女助理莎拉(Sarah Vanitha Devaraj),更控诉惨遭男警员的性骚扰。
今早一起到人权委员会办公室提呈备忘录的人士包括,在集会中遭致伤入院接受治疗的颜贝倪和公正党雪州行政议员黄洁冰的助理卢传文,被逮捕的公正党灵南区国会议员许来贤的助理骆文吉(左图中)和查尔斯的另一名助理黄业华,以及雪隆公正队执行长李凯伦等一行人。
他们在备忘录中,抨击警方当天的行径等同侵犯基本人权,并希望人权委员会能够召开公开听证会,彻查此事。
西华认同有权和平集会表态
人权委员会委员西华在接收备忘录时,也认同集会者的确有权举行和平集会,来表达他们对赵明福离奇坠楼事件的感受。
他表示,该委员会将交由投诉和调查小组展开初步调查,包括向警方索取详情,然后才在8月10日召开的会议中,决定是否要召开听证会。
300名民联支持者及许多雪州民联议员的助理是在上周五于雪州反贪会总部所在的沙亚南商业广场示威,要求针对赵明福案调查反贪会。
不料却遭警方出动镇暴队强力驱散,并逮捕了7人包括雪州加埔国会议员马尼卡 、雪州行政议员西维尔以及数名政治助理。在冲突过程中,卢传文和颜贝倪(上图中)也被致伤而入院。
颜贝倪和助理遭男警员推挤
颜贝倪(左图)在提呈备忘录时指出,她当时是集会的最后一名演讲者,结果却遭到一些身穿便衣的不明男性的拉扯,及抢走其手中的扩音器。她认为,这些男性的举动构成性骚扰。
“那些拉我的人都是男性官员,这让身为女性人民代议士的我,觉得受到骚扰。”
她也指责,镇暴队队员那时包围在其身后和大力推挤,结果导致她跌倒在地上和敲到头,额头出现淤青,必须送院接受治疗。
“我身为人民代议士都已经受到警方的粗暴对付,我无法想象普通人民将会面对怎样的对待。”
由于莎拉今早不克出席,其同僚黄业华则代为投诉说,她遭到男性警员的手推脚踢,甚至推她的上身,因此已经构成性骚扰。
昏晕却仍遭警员在地上强拖
卢传文和黄业华也向西华投诉,警方在试图逮捕他们时行使暴力,甚至在他们近乎昏晕的情况下,警员仍然在地上强行拖走。
卢传文声称,他在试图阻止警方逮捕颜贝倪时,遭到数名便衣警员强行拖走多达30米,随后就跌到在地上,而警员也使用手铐铐住他的手。
他表示,虽然他当时坚持和平集会没错而无需铐手,并多次投诉感到脚痛,但是警方还是强行拖走他,甚至用脚踩在其身上,结果他第二次跌到在地。
“尽管黄洁冰上前表明我是其雇员,并尝试和警方谈判,但是他们还是不理睬,继续强行拉扯手铐,直到我手上充满红色伤痕后才愿意释放我。”
卢传文指出,朋友将他带往其他地方休息,而他随后才清醒过来,发现自己处在沙亚南广场里面。
他随后也被送往巴生医院治疗。
播录影短片证明警暴力驱散
黄业华(右图)则控诉,他是在尝试救出卢传文时遭警方捉住。
“尽管我尝试挣扎及近乎昏晕,但是警员还是强行将我拖行长达50米”。
他表示,直到莎拉前来协助后,他才成功脱难。
颜贝倪等5人在较早时也播放4个录影短片,证明警方的确行使暴力来驱散集会者。其中,镜头可以清楚看到数名便衣警员在地上拖走卢传文,以及有一只脚踩在卢传文身上。
他们也在备忘录中向人权委员会提出另外4项要求,分别是确保警方尊重宪法赋予的人权、在集会现场发生警方侵犯人权时就率先干涉、施压政府废除限制集会和言论自由的法律,以及施压政府成立警察投诉和滥权独立委员会(IPCMC)。
黄业华更向西华施压说,人权委员会必须认真看待他们的投诉。他表示,他们也会提呈这份备忘录给负责监督人权委员会表现的国际协调委员会(ICC),并希望人权委员会能够继续保住A等的评级。
