KLANG – Settlers who have been asked to vacate their homes to make way for a housing project at  Jalan Papan and Bukit Kerayong in Pandamaran, near here,  will take the issue to the Malaysian Anti-Corruption Commission.

They plan to be at the MACC office on Wednesday to file a report against TPPT Sdn Bhd over an alleged mishandling of a land issue that has purportedly affected their status as the rightful settlers there.

bkt-kerayong-4.jpgThe settlers do not want the fate that befell on the villagers in Kampung Buah Pala in Penang to also happen to them.

Like the Buah Pala settlers, the folks at Jalan Papan and Bukit Kerayong have also become victims of urban redevelopment and have been asked to clear out of their homes to make way for a mixed housing project in their area.

Deadlines have passed

The villagers were first asked to vacate the land by July 31. This was then extended to Aug 8.

The two deadlines have passed and the settlers are adamant about staying put on their land, which had been passed through the genrations since the first pioneeers cleared the wilderness there over 70 years ago.

“Our families have been living there for decades, our ancestors used their own savings to develop this place and now.. we are asked to move out to make way for a multi-million housing project,” said Jalan Papan and Bukt Kerayong action committee chairman Ang Mah Chye.

He said they will not budge and have started on a signature campaign to garner support for their cause.

Ang and his deputy, Dominic See, led the first phase of the campaign at the Pandamaran morning market on Aug 30; the eve of the country’s 52nd National Day.

They will carry out the signature campaign every week and, armed with the support of the people, will file a petition with the relevant authorities to reinstate the lands in their hands.

TPPT set up to benefit rakyat

They also intend to get the MACC to investigate TPPT Sdn Bhd, which was originally entrusted by the Abandoned Housing Project Fund to revive incomplete housing projects and develop affordable homes for various target groups.

TPPT, however, has allegedly sold the deal to development company Melati Ehsan Holdings Bhd for RM32mil and the company then drew up a plan for a proposed ‘Taman Ehsan Jaya’ that can potentially generate for it a revenue of RM150mil.

“TPPT was not established for monetary profit but for the benefit of the Rakyat. They were not honouring their agreement.

“The amount of RM150mil clearly showed their actions are not in line with the objective of TPPT, which was established to assist the lower income group rather than the middle or higher income.

“They should build more houses are affordable for the target groups,” he added.

Getting Zeti to intervene

Ang said they also hope to meet Bank Negara governor Zeti Akhtar Aziz and to get her to intervene in the matter, since the central bank is responsible for the setting up of TPPT in 1990.

“I hope the Bank Negara governor will hear the plight of the settlers and will call for a more considerate initiative by the developer in resolving the issue and to put the development project on hold,” he said.

The settlers hope their land, allegedly taken away from them, will be returned and they will also be given permanent land titles.

bkt-kerayong-5.jpgThey also plead not to be driven out from their homes until further discussions are held between the state government, residents and developer and an amicable solution is found.

In addition, they hope that the plan to build a hypermarket at Bukit Kerayong will be scrapped.

The settlers also hope the MACC will charge the culprits, if any impropriety is found, and penalize them.

Supporting their cause

Klang MP Charles Santiago who had been supporting the settlers’ cause said  it was ‘inhumane’ to shove the families that had stayed there for over 70 years and  who were responsible for clearing the jungles and swamps there to make the village suitable for decent living.

“It is disheartening to see the Bukit Krayong families fighting for their land through campaigns.

“ The prime minister talks about ‘1Malaysia’ that puts the people first. In this case, the people have been sidelined.

“For me, there is an element of impropriety and I will accompany the action committee to lodge a report on TPPT at the MACC tomorrow (Wednesday),” he said.

Pulangkan hak tanah kepada peneroka Bandar!

(Klang) Jawatankuasa Bertindak Perpindahan Jalan Papan dan Jalan Bukit Kerayong yang dipimpinkan oleh Ang Mah Chye dan Dominic See melancarkan kempen tandatangan petisyen di pasar pagi pandamaran pada jam 9:30am, 30hb Ogos 2009.

Kumpulan peneroka Bandar in mengecam tindakan bekas kerajaan Selangor Barisan Nasional yang merampaskan tanah mereka secara tidak sah dan tidak demokratik. Mereka mendeksa kerajaan persekutuan, kerajaan negeri pakatan kini, wakil-wakil rakyat, penduduk pandamaran dan semua rakyat Malaysia menyokong 4 saranan mereka :

1) Pulangkan hak milik tanah Jalan Bukit Kerayong dan Jalan Papan kepada penduduk asal dan berikan geran tanah kekal kepada mereka; 2) Membuat siasatan terperinci dan telus atas penyelewengan tukar hak milik tanah dan syarat-syarat yang dikenakan oleh kerajaan negeri Selangor; 3) Hentikan pengusiran secara paksa dan sebarang perobohan sehingga perundingan di antara kerajaan, penduduk dan pemaju diselesaikan; 4) Membantah rancangan pemaju membina sebuah hypermarket di atas tanah Jalan bukit Kerayong.

Turut hadir ialah Ahli Parlimen Klang Charles Santiago, Charles berkata beliau sokong sepenuhnya penduduk menuntut hak tanah mereka, adalah tidak wajar pihak berkuasa menganggap mereka penduduk setinggan haram kerana mereka telah meneroka hutan paya ini 70 tahun dulu, tiga generasi penduduk telah tinggal di situ.

Beliau mengutuk sekeras-kerasnya pemilik tanah iaitu Tabung Projek Perumahan Terbengkalai (TPPT) Sdn Bhd menjualkan tanah kepada Melati Ehsan dengan harga RM32 juta dan Melati Ehsan berjangka akan mendapat keuntungan sebanyak RM150 juta daripada projek pembangunan ini. Ini jelasnya bercanggah dengan objektif penubuhan TPPT Sdn Bhd iaitu meningkatkan kemampuan rakyat memiliki rumah dengan membekalkan rumah kepada golongan pendapatan rendah.

Charles berasa kecewa sebab sempena sambutan hari kemederkaan, peneroka Bandar pandamaran terpaksa menlancarkan kempen-kempen untuk menuntut balik tanah mereka, slogan satu Malaysia tidak bermakna kepada mereka kerana apa yang mereka saksi ialah “Keuntungan diutamakan, rakyat dipinggirkan”

Pengerusi Jawatankuasa Bertindak Perpindahan Jalan Papan Ang Mah Chye berharap penduduk-penduduk pandamaran memberi sokongan kepada kempen tandatangan petisyen ini, bukan sahaja menolong penduduk kedua-dua tempat tapi membantah juga pembinaan hypermarket yang dirancangkan oleh pemaju supaya menyelamatkan peniaga-peniaga kecil dan sederhana di pandamaran.

【本刊记者撰述】武吉哥拉容搬迁委员会主席徐志荣和巴板路搬迁委员会洪马再前天早上领导村民在班达马兰早市发动签名运动,呼吁班达马兰居民支持他们的斗争。

他们强烈抨击前雪州国阵政府以无理和不民主的方式夺取他们的土地,他们促请联邦政府、雪州民联政府、人民代议士和全国人民支持他们的四点诉求:

(一)归还武吉哥拉容和巴板路居民的土地拥有权,给予他们永久地契;
(二)透明和详细地调查土地转让弊案和州政府施加的发展条件;
(三)停止逼迁和拆除行动,直到州政府、居民和发展商之间的谈判结束;
(四)反对发展商打算在武吉哥拉容土地兴建霸级市场的计划。

出席者包括巴生国会议员查尔斯圣地亚哥,他全力支持居民争取回他们的土地拥有权,认为政府不该把他们视为非法木屋区居民。这群城市拓荒者早在70年前已开垦红树林区,推平土地建立自己的家园,有些家庭已三代居住在此。

发展商将可牟取暴利

查尔斯强烈批评土地拥有者废置房屋计划基金(TPPT Sdn Bhd)以3200万元的价格售卖这片土地给亿成控股(Melati Ehsan Holdings)。亿成控股估计这项房屋计划将为该集团带来1.5亿元的盈利。

他表示,这明显已违反州政府开出的条件,既这项房屋计划不能以谋利为导向,反之该专注于解决社会问题。

他也指出,这项计划违反国家银行成立该基金的目的——提高人民拥有房屋的能力和提升低收入群体的生活水平。

对于这群班达马兰拓荒者必须在国庆前夕发动签名运动,拯救他们的土地和房子,圣地亚哥感到非常遗憾。他认为“一个马来西亚”的口号对村民没有任何意义,因为他们的真实经验是“利益放第一,人民被边缘”。

巴板路搬迁委员会主席洪马再呼吁班达马兰居民支持他们的签名运动,不只协助两地村民争取土地权,也反对发展商在此兴建霸级市场,危及班达马兰中小商家的生存。

Unhappy residents start signature campaign to regain land in Pandamaran

TABUNG Projek Perumahan Terbengkalai (TPPT) Sdn Bhd, the initial developer of Jalan Bukit Kerayong and Jalan Papan, Pandamaran has finally broken its silence over the controversial matter.

TPPT, which is a subsidiary company of Bank Negara, sent a letter to Klang Member of Parliament Charles Santiago to explain their position in the matter.

According to managing director Hidzir Yahya, many efforts were taken by the developer to resolve the matter but failed as residents were asking for unreasonable compensation.

“After we obtained the land from the State government in 1995, we had several meetings with the residents and it was agreed upon that we would build 528 low cost houses for the residents of Jalan Bukit Kerayong and Jalan Papan. A compensation of RM 7,000 for every house would be paid through the local council and we also agreed to build 100 units of double-storey houses worth RM 180,000 each but priced at RM 100,000 for the residents,”

Hidzir said in his written response to Malay Mail. “However, after agreeing to all this, the residents changed their minds and started to demand for unreasonable compensation. Therefore, unable to endure the losses caused by this project, TPPT chose to sell this land to Melati Ehsan Berhad, as they have vast experience and the resources to deal with this type of cases,” he added.

TPPT obtained the 189.67 acres of land from the State government in 1995 as part of the Zero Squatters Programme. The company had already paid the land premium,  hence making it the lawful owner of the land.

On a different note, residents of  Jalan Bukit Kerayong and Jalan Papan launched a signature campaign to regain their land. The campaign was led by Bukit Kerayong action committee members Ang Mah Chye and Dominic See at the Pandamaran wet market last Sunday.

Santiago was also there to show his support for the residents. On Aug 5, Malay Mail highlighted the plight of the 28 families living at Jalan Bukit Kerayong who cried foul when they were given evacuation notices from Melati  Ehsan. The residents were told to move out by Aug 1. However, the families are adamant that they have rights to the land.

Since 2005, the Klang Municipal Council has demolished numerous houses at Bukit Kerayong and provided
reimbursements of RM7,000 to each family.

On Aug 17, it was highlighted that residents alleged foul play in the land deal by TPPT and Melati Ehsan. The residents later held a demonstration outside Bank Negara because their needs were not met.

RESIDENTS of Kampung Bukit Kerayong and Jalan Papan in Pandamaran, Klang, are angry over the lack of response from Tabung Projek Perumahan Terbengkalai (TPPT) Sdn Bhd in solving their grouses. They have threatened to hold a protest at Bank Negara within two weeks.

This was announced by Klang Member of Parliament Charles Santiago yesterday, on behalf of the affected residents.

“We are going to send a letter to TPPT and we will give it two weeks to respond. If it fails to do so, we will organise a protest outside Bank Negara and we will also lodge a report with the Malaysian Anti-Corruption Commission,” said Santiago.

“We want a response from TPPT on why the land was sold to a private developer. We had a meeting with TPPT last week, but no answers was given to residents,” he added. TPPT was established by Bank Negara Malaysia in 1990 to manage government funds in the rehabilitation of abandoned housing projects.

It was in charge of the Bukit Kerayong and Jalan Papan land matters.

However, TPPT sold the land to a private developer, Melati Ehsan Holdings Bhd, which served evacuation notices to the residents of Bukit Kerayong and Jalan Papan last month.

The residents of Kampung Bukit Kerayong and Jalan Papan claim rights to the land as they have been living there for the past 70 years.

They also claim that there could be some fraud in the land dealings between TPPT and Melati Ehsan. Its original transfer to TPPT by the State government had a clause stating it was given to TPPT to uphold the social welfare of the people, Santiago had said.

However, the land had been sold  to Melati Ehsan for an astonishing RM32 million, Santiago added.

Peneroka Bandar di Jalan Papan dan Jalan Bukit Kerayong meminta agar pemilik tanah TPPT Sdn. Bhd. mengadakan satu dialog dengan mereka supaya menyelesaikan masalah yang dihadapi oleh mereka.

Pengerusi Jawatankuasa Bertindak Peneroka Bandar Jalan Papan, Ang Mah Chye menyaran Governor Bank Negara, Zeti Akhtar Azi menunjukkan keprihatinan terhadap situasi peneroka Bandar yang menerima notis pengusiran, kerana pemilik tanah TPPT merupakan sebuah anak syarikat yang tubuh dibawah Bank Negara.

Lebih kurang 20 orang penduduk dari kedua-dua kawasan menganjurkan satu sidang media bersama Ahli Parlimen Klang, Charles Santiago di Pusat Komuniti Ahli Parlimen Klang pada hari ini.  Mereka memberi TPPT tempoh masa dua minggu untuk mengadakan dialog ini, jikalau tidak penduduk akan mengadakan tunjuk rasa di TPPT.

Peneroka Bandar Jalan Bukit Kerayong telah menerima notis pengusiran daripada pemaju pada bulan Julai 2009.  Pemaju menuduh bahawa mereka menceroboh tanah punyaan pemaju.

Charles berkata, peneroka Bandar Jalan Bukit Kerayong telah tinggal di kawasan tersebut selama 70 tahun, maka mereka tidak harus dilihat sebagai penduduk setinggan dan mengabaikan sumbangan mereka dalam penerokaan tanah ini.

Katanya, beliau akan berbincang dengan Exco Kerajaan Selangor Iskandar Abdul Samad untuk mendeksa supaya TPPT mengadakan dialog dengan peneroka Bandar ini.

Menurut beliau, tujuan penubuhan TPPT adalah untuk memulihkan projek perumahan terbengkalai, membina rumah dengan harga berpatutan untuk mempromosikan pemilikan rumah, terutamanya golongan yang berpendapatan rendah.

Namun demikian, pemaju projek perumahan itu, Melati Ehsan, mengatakan projek ini akan mendatangkan keuntungan sebanyak RM150 million kepada syarikat itu.  Ini jelas menunjukkan bahawa projek perumahan ini telah bercanggah dengan objektif penubuhan TPPT.

Penduduk juga menunjukkan Lesen Pendudukan Sementara (TOL) yang diberikan kepada penduduk pada tahun 1964, syarikat pemaju hanya menandatangani perjanjian pembangunan ini pada tahun 2007.  Maka, adalah tidak masuk akal jika dikatakan peneroka Bandar menceroboh tanah pemaju.

SQUATTERS and holders of Temporary Occupation Licences (TOL) do not have any right to the land they occupy, for the law does not recognise it, says lawyer Abdul Shukor Ahmad.

Having been in practice for 15 years, Shukor said squatters and those whose TOL had expired are not entitled to compensation if they are told to move out.

“The National Land Code (NLC) clearly states that a person living as a squatter does not have any right to compensation because the land is being occupied illegally,” he said.

“The same goes for TOL holders. moment the licence expires, the land goes back to the State, which is the rightful owner.”

Asked about claims by squatters that they have a right to the land they have lived on for decades and even helped to develop it, Shukor said: “Under section 48 of the NLC, it is called adverse possession or in simple words, just because you have occupied a piece of land for certain number years, it does not make it yours.

“Squatters can apply to the State to alienate the land to them for a number of years. The State can then charge a premium for each year the land is occupied and at the end of the lease period, the State can decide whether it wants to continue leasing out the land or take it back.”

Kota Alam Shah assemblyman M. Manoharan said: “State can acquire the land and lease it to the people. If they are living on State land, it would be easier. believe that the people should be given the land to be leased out to them.”

On Wednesday, Malay Mail highlighted the plight of 28 families living at Jalan Bukit Kerayong, Pandamaran,
who cried foul over being given evacuation notices by a developer. They claim they have every right to the land.
he developer, Melati Ehsan Holdings Bhd, served notice to these families after buying the land from TPPT Sdn Bhd, a Bank Negara subsidiary company created to rehabilitate abandoned housing projects.

The families were given one month to evacuate and the time given ended last Saturday. However, the families are adamant that they have right to the land.

The residents turned to Klang MP Charles Santiago, who has asked the developer to reconsider the evacuation notice.

Both Santiago and the State executive councillor for Housing, Building and Squatters, Iskandar Abdul Samad,
have written to the developer requesting it to withhold the evacuation order until negotiations have been conducted with the residents.

Since 2005, the Klang Municipal Council has demolished numerous houses at Bukit Kerayong and given the occupants RM7,000 in compensation.

Now, there are only several houses and a Chinese temple left in the area.

KLANG – Another subbukit-kerayong-1.jpgurban village is under siege by development. After decades of staying at the Jalan Bukit Kerayong settlement in Pandamaran, near here, 28 families there have allegedly been asked to move out to make way for a hyper mall project.

They alleged they had been served an eviction notice by a lawyer of the development firm, telling them to stay away from the place within 30 days.

The settlers said their families had stayed there for over 70 years and the pioneers were responsible for clearing the jungles and swamps there to make the village suitable for decent living. They now fear that soon, the bulldozers will move in to crush their homes.

Deadline extended to Aug 8

Contacted on Tuesday, Klang MP Charles Santiago said the deadline for the month-long notice was July 31. The settlers have since been given a ‘grace period’ up to Aug 8 to pack their belongings and go.

He said three weeks from this day; the demolition men will visit the village.

The settlers have turned to Santiago and Selangor state housing and squatters committee chairman Iskandar Abdul Samad to resolve their problem. Both have appealed to the developer to defer its demolition plans until the state government has discussed the issue with the affected families.

Santiago called for a more compassionate initiative on the part of the developer in resolving the matter and to put on hold the project, which he said would also have an impact on small and medium-sized businesses in Pandamaran.

‘Resolve the issue in humane manner’

Selangor and Federal Territory Community Association (Permas) chairman Tan Jo Hann also appealed to the developer to resolve the issue in a more humanitarian manner, saying the settlers have a stake in the land even though it is considered a government land since they had been there long before the country’s independence.

He said it was absurd to ask the settlers to provide documents on the land as they were not given any papers when their ancestors first settled there in British colonial times.

Bukit Kerayong action committee chairman Dominic Yong said the settlers want the land returned to them so that their families can permanently stay there.

It is learnt that since 2005, the Klang municipal council had demolished several squatter homes in Bukit Kerayong and had given RM7,000 each as compensation to affected families,

There still remain several other squatter houses, a few factories and a Chinese temple in the area.

Statistics in 2003 showed there were 1,400 people living in Bukit Kerayong.

No more a fortified place

In 1964, the local district office had allegedly given temporary occupation licence (TOL) to a portion of the settlers and in October 1993 then Klang district officer Mohamad Ghazali Yahaya reportedly announced that all settlers would be awarded TOLs.

Ahead of the 1995 general elections, the mentri besar at that time, Muhammad Muhammad Taib told a political gathering in Pandamaran that about 1,000 TOLs had been approved in two areas there.

However, after the elections of that year, Pandamaran state assemblyman Teh Chang Eng reportedly announced that a land application by a developer had been approved in Bukit Kerayong.

Like a fortress attacked, Bukit Kerayong is no more a fortified place for the settlers as the process of isolating them from their homes have started and their resistance continues to ebb.
