THE National Water Services Commission (SPAN) operates without prejudice according to Energy, Green Technology and Water Minister Datuk Seri Peter Chin Fah Kui yesterday.

“As a matter of its operating procedures SPAN will set up its own investigations as to the causes for any major breakdown of treatment plant or other facilities under operation by its licensees,” replied Chin in an SMS to The Malay Mail.          

“This case is no exception. SPAN will carry out its duties herein,” he said.

Chin was commenting on SPAN being called out by an opposition lawmaker to make public its findings on the maintenance and technical audit of water treatment concessionaire Puncak Niaga Holdings Bhd.

Klang MP Charles Santiago, during a press conference said the audit would show that pumps in the Wangsa Maju treatment plant were poorly maintained which resulted in one of them failing, leaving thousands of families in the area without water.

Calls to SPAN revealed that chief executive officer Datuk Teo Yen Hua was outstation and unavailable for comment but is expected to return today.

மேலும் மக்கள் நலனில் ஆர்வம் உள்ள சிலாங்கூர் அரசாங்கம், சபாஷ் நடவடிக்கைகளை எடுத்துக் கொள்வதின் வாயிலாக  இலவச நீர், குறைந்த கட்டண நீர் சேவை, தரமான தண்ணீர் மற்றும் சிறப்பான சேவைகளையும்  வழங்க முடியும் என்பதால் இந்த மாற்றம் மிக முக்கியம் எனவும் இதற்கு மத்திய அராசங்கம் இணக்கம் காட்ட வேண்டும் எனவும் கேட்டுக் கொண்டார் சார்ல்ஸ்.

 

Avoid these water audit firms, MP tells S’gor gov’t

DAP’s Klang MP Charles Santiago today called on the state government not to use the services of water audit firms Halcoo, Suez and Wessex Water to verify reports by Syabas.

This, Santiago explained, was because these audit firms have existing work with the federal government and using them could raise a “conflict of interest”.

“They should use an independent body, such as the International Water Association,” the MP told Malaysiakinitoday.

Santiago (right) also argued that even the reports from Syabas were “suspect” and urged the team that is to monitor the water concessionaire to gather data required by itself and not to depend solely on the daily reports from Syabas.

“What we need is a full forensic audit.”

Santiago was referring to the oversight body that Selangor is setting up to monitor Syabas operations before the state government moves to take over the concessionaire’s operations.

Selangor has said it has lost confidence in the capability of Syabas to deliver its contractual obligations as the water supplier in the state.

The oversight body comprises state secretary Mohamed Khusrin Munawi, state water regulator Nordin Sulaiman and the three water audit firms that are supposed to vet and verify Syabas’ daily reports.

Santiago also wants Syabas to explain water disruptions happening in the state in the last few weeks around Seri Kembangan, Klang and Hulu Langat.

He urged the concessionnaire to disclose whether it is because of infrastructure problems or is it part of the water rationing it has announced last week.

“If it is water rationing, it is illegal as they have yet to obtain approval from the National Water Services Commission (Span) as per the Water Services Industry Act 2006.”

And whatever the cause of the disruptions, Santiago said that Syabas has an obligation under Section 54 (123) of the Act to replace the water loss to consumers via other means such as water tankers and tanks, something he argued the company failed to do in affected areas.

மூன்று நீதிபதிகளைக் கொண்ட முறையீட்டு நீதிமன்றம் அதனை விசாரிக்க இன்று கூடியது. அந்த முறையீட்டில் எழுப்பப்பட்டுள்ள விஷயங்களை மேலும் ஆராய வேண்டியிருப்பதால் முடிவு எடுப்பதற்கு நீதிபதிகள் குழுவுக்கு இன்னும் கால அவகாசம் தேவைப்படுவதாக அது அறிவித்தது.

நீதிபதி ஸாலேஹா ஸஹாரி தலைமையிலான நீதிபதிகள் குழுவில் நீதிபதி அபு சாமா நோர்டினும் நீதிபதி முகமட் ஹிஷாமுடின் யூனுஸும் இடம் பெற்றிருந்தனர்.

“நாங்கள் பல வழக்குகளை விசாரித்ததால் அந்த விவகாரத்தை விவாதிக்க உண்மையில் எங்களுக்கு நேரம் இல்லை. நாங்கள், அதிகாரிகள் பற்றியும் எங்களுக்கு சமர்பிக்கப்பட்ட வழக்கு தொடர்பான சட்டங்களையும் ஆராய வேண்டியுள்ளது,” என்று நீதிபதி ஸாலேஹா கூறினார்.

அந்த வழக்கில் நீதிபதிகள் கூடுதல் கால அவகாசம் கோரியிருப்பது அந்த வழக்கின் முக்கியத்துவத்தை உணர்த்துவதாக அந்த வழக்கில் பிரதிவாதிகளில் ஒருவரான கிள்ளான் எம்பி சார்லஸ் சண்டியாகோ தெரிவித்தார்.

நீதிபதிகள் செய்யும் முடிவு நாம் விரும்புகிற வெளிப்படையான போக்கு நல்ல நிர்வாகம் ஆகியவை மீது ஆழமான தாக்கத்தை ஏற்படுத்தும்,” என்றும் அவர் கருதுகிறார்.

“அந்த முடிவு அது போன்ற மற்ற ஒப்பந்தங்கள் மீது தாக்கத்தைக் கொண்டிருக்கும். டோல் கட்டண சாலைகள் மீதான சலுகை ஒப்பந்தங்களும் அவற்றுள் அடங்கும். முறையீட்டு நீதிமன்றத்துக்கு கூடுதல் அவகாசம் தேவைப்படுவது உயர் நீதிமன்ற முடிவை அது நிலை நிறுத்துவதற்கு வழி வகுக்கும் என நாங்கள் நம்புகிறோம்,” என சண்டியாகோ குறிப்பிட்டார்.

Water crisis row: Raid Syabas, says MP

The federal government should declare a state of emergency, since it is insisting that Selangor will face a water crisis at the beginning of 2012, Klang DAP parliamentarian Charles Santiago says.

According to Deputy Energy, Green Technology and Water Minister Noriah Kasnon, 1.5 million consumers in Selangor and the federal territories of Kuala Lumpur and Putrajaya would suffer water shortage unless Selangor agrees to land acquisition for Pahang to resume the Interstate Raw Water Transfer Project.

“(Therefore), the federal government should declare this as an emergency and raid the offices of Syabas (Syarikat Bekalan Air Selangor Sdn Bhd),” Santiago (left) said.

“If it is indeed an emergency, then you have to reduce non-revenue water (NRW), which is at 32 percent and going to waste,” he added.

Noriah had said that only the Hulu Langat water treatment plant – the tail-end of the raw water transfer project – must be completed to secure Selangor’s water supply until 2025.

However, the state government has repeatedly argued that Selangor’s water woes would be delayed if the concessionaire reduced the NRW.

‘Figures given are inaccurate’

Selangor Menteri Besar Khalid Ibrahim had also said that figures and projections cited by the federal government and the concessionaire to push for immediate progress in the raw water transfer project were inaccurate.

Santiago, who is also coordinator of the Coalition Against Water Privatisation, said even the NRW figures could be distorted as detailed information has been classified under the Official Secrets Act (OSA).

“Nobody knows because the concession agreement (involving the federal and Selangor governments and Syabas) and the audit report are classified under OSA,” he said.

“Given that it is an emergency, and with clauses in the Water Services Industry Act providing for a state of emergency, the federal government can come up with policies (to facilitate investigation).”

What are Syabas and federal gov’t protecting?

With just two years left before 2012, Santiago added, the federal government should initiate the raid on Syabas “within the next two weeks” and get an independent firm to audit its books.

Malaysian Trades Union Congress president Syed Shahir Syed Mohamed and 13 others had in 2007 filed for judicial review to compel the ministry, the federal government and the Selangor government to make the water concession agreement and audit report public.

In a landmark judgment on June 28 this year, Kuala Lumpur High Court judicial commissioner Hadhariah Syed Ismail ordered the contents of the documents to be disclosed.

She also stated in her 19-page decision that she was not convinced such disclosure would be detrimental to national security or public interests.

However, Hadhariah granted a stay order to the Energy, Water and Green Technology Ministry and the federal government, pending an appeal, on the grounds citied by the two parties that disclosure would “upset the administration of government”.

Asked Santiago: “Why would this information upset government administration, unless they are protecting information about the NRW?

“Syabas is milking the cow… but why should it milk the cow when water is not a private commodity, it is a human right.”

Last week, the United Nations General Assembly adopted a resolution declaring access to clean water and sanitation as a fundamental human right under Article 12.1 of the International Covenant on Economic, Social and Cultural Rights.

Do proper study before deciding on Kelau Dam project

KLANG: Coalition Against the Privatisation of Water coordinator Charles Santiago has urged the Federal government to come up with a research paper on the impact of climate change to substantiate claims that Selangor faces water rationing.

“Without proper studies, the Federal government cannot push through the plan to source water from the Kelau Dam in Raub, Pahang as it is not a viable answer to ensure enough water,” he said.

Santiago who is also Klang MP added that Energy, Green Technology and Water Deputy Minister Noriah Kasnon had said the Kelau Dam was needed to secure Selangor’s water supply until 2025.

“Now the rain falls around the catchment areas surrounding the Kelau Dam but what happens if due to climate change the rain moves to Kelantan or Terengganu?” Santiago asked.

The Kelau Dam has been stalled as the Federal government is waiting for the Selangor government’s approval to acquire land for the piping work, he said.
