Perdana Menteri, Datuk Seri Najib Abdul Razak silap ketika mendakwa tiada persamaan antara kematian Teoh Beng Hock dan penolong pengarah Kastam, Ahmad Sarbani Mohamed, kata beberapa ahli parlimen Pakatan Rakyat hari ini.

NONEDengan menolak persamaan antara kedua-dua kes berkenaan, Najib sebenarnya cuba memperlihatkan ketidak-seriusan dalam kematian Ahmad Sarbani ketika dalam jagaan Suruhanjaya Pencegahan Rasiah Malaysia (SPRM).

“Najib adalah salah kerana ada persamaan dengan kematian Teoh Beng Hock. Kedua-dua mereka mati di bangunan kerajaan kettika dalam tahanan agensi pihak berkuasa,” kata ahli parlimen Klang, Charles Santiago.

Santiago dan tiga lagi ahli parlimen – MP Shah Alam Khalid Samad, MP Teluk Intan M Manogaran dan MP Kota Raja Dr Siti Mariah Mahmud hari berjumpa dengan pengarah SPRM Selangor Datuk Jaafar Maahad bagi melahirkan kebimbangan mereka berhubung keselamatan orang ramai kepada suruhanjaya itu.

Keempat-empat ahli parlimen itu diiringi kira-kira 20 penyokong, bertemu Jaafar kira-kira 10 pagi tadi.

NONEKhalid berkata pertemuan kira-kira 30 minit itu diadakan bagi mendapat penjelasan daripada SPRM berhubung beberapa perkara termasuk kes kematian Ahmad Sarbani pada Rabu lalu.

Beliau berkata pihaknya berpuas hati dengan penjelasan yang diperolehi daripada Jaafar termasuk memberi jaminan bahawa SPRM negeri sentiasa memastikan semua pegawainya mematuhi prosedur siasatan yang ditetapkan.

“Dalam pertemuan ini, kami juga melahirkan kebimbangan orang ramai berhubung keselamatan saksi atau tertuduh dalam kes rasuah apabila dibawa ke premis SPRM,” katanya ,

Sementara itu, Bernama melaporkan bahawa hampir 50 anggota polis dilihat mengawal dan menyekat laluan menuju ke Wisma PKPS di Shah Alam sejak 8.30 pagi tadi dipercayai bagi mengelakkan sebarang kejadian yang tidak diingini.

NONERabu lalu, Penolong Pengarah cawangan Import Eksport dan Kawalan Sempadan KDRM Selangor, Ahmad Sarbani Mohamed, 56, ditemui mati di tingkat satu pejabat SPRM Wilayah Persekutuan, dipercayai terjatuh dari tingkat tiga bangunan itu.

Allahyarham didakwa datang secara sukarela ke pejabat SPRM untuk berbincang sesuatu mengenai siasatan kes rasuah dengan pegawai penyiasat suruhanjaya tersebut.

Ekoran kejadian itu, dua pegawai SPRM digantung tugas kerana ingkar perintah berhubung pengendalian saksi yang berkaitan dalam kes kematian berkenaan.

SHAH ALAM, April 8 — Police tightened security around the Malaysian Anti-Corruption Commission (MACC) office here today to prevent protests for or against the anti-graft body, and briefly detained a man who unfurled a placard.

The man was arrested by uniformed officers at around 12.20pm just two minutes after he and six other men unfurled crudely-made placards in front of Wisma PKPS, where the Selangor MACC is based.

The placards read “Biar police siasat, jangan ganggu siasatan police” (Let the police investigate, don’t interfere in police investigations) and “Pergi jahanam DAP” (Go to hell DAP).

Shah Alam district police chief Zabedi Ayob told The Malaysian Insider the man, who looked to be in his 40s, was later released without charge.

“Since the illegal assembly did not happen, we decided to let him off with a warning,” he said.

Klang MP Charles Santiago had earlier wanted to hand a memorandum to the Selangor MACC, along with other Selangor lawmakers and civil society groups, just two hours before the arrest.

Some 50 policeman had cordoned off the road in front of Wisma PKPS in anticipation of a possible protest.

Santiago, who is Selangor DAP vice-chairman, has described the MACC as a “house of death” following the death of Selangor Customs assistant director Ahmad Sarbani Mohamed at the MACC office in Jalan Cochrane, Kuala Lumpur, the second such death in just under three years.

Ahmad Sarbani was found dead on the ground outside the Kuala Lumpur MACC office at about 10.20am on Wednesday. He is believed to have fallen out of the building’s third-floor window.

His death comes as a royal commission of inquiry (RCI) is investigating MACC operational procedures and the death of DAP political aide Teoh Beng Hock, who died in MACC custody two years ago.

Teoh was found dead on the fifth floor of Plaza Masalam in Shah Alam on July 16, 2009 after an overnight interview at the then-Selangor MACC headquarters on the 14th floor.

【本刊陈慧思撰述/摄影】四名雪州民联国会议员今早赴位于雪兰莪莎亚南的雪州反贪委总部,要求反贪委就雪州关税局官员阿末沙巴尼离奇死亡事件作出交待。警方因担心现场出现集会而派出大约50名制服警员严阵以待,在该办公楼前的交通圈设置路障封路。

上述四名民联国会议员主要是要向嘉化玛哈了解阿末沙巴尼(Ahmad Sarbani Mohamed)命案的详情,并要求反贪委就沙巴尼离奇横尸反贪委办公楼一事作出解释,以及向反贪委提出建议,如设定盘问证人程序、增设闭路电视等。

《独立新闻在线》昨天收到短讯,号召公众到雪州反贪委总部前集会。收到消息的警方严阵以待,派出数辆警方卡车、大约50名制服警员在总部大楼前的交通圈设置路障,封锁两条道路。

查尔斯接受记者采访时透露,原本有300名关税局跑腿要随他们到雪州反贪委总部示威抗议,可是昨晚至今早他们接到数通电话,警告他们一旦参与示威,就会被革职,以致最终示威活动流产。

命案疑窦重重

卡立沙末表示,在反贪委办公楼范围内发生命案,是没法让人接受的;虽然命案并非发生在雪州,但他们是雪州议员,因此他们前往雪州反贪委总部,要求反贪委解释及透明彻查这起命案。

他说,嘉化玛哈认同,上述命案不该发生,因这宗尚在调查中的案件罪不至死,并称雪州反贪委依循条规,安装闭路电视,并规定官员需在证人踏入反贪委范围内至离开时陪同在侧。

查尔斯表明支持反贪委追查洗黑钱、逃税、不法献金等贪腐案件,但与此同时,他们必须保护证人和嫌疑犯。

他说,在阿末沙巴尼命案中,政府称他是自行回到吉隆坡反贪委总部,但是亦有说他是被要求回到隆反贪委总部,没有人知道谁真谁假。

马诺哈然(左图左)则说,在他当律师的经验中,他从未看过有嫌疑犯会自行回到调查单位,他必然是因被传召方会回到调查单位。

他且问道:“有说他自杀,但是为什么他要到反贪委自杀,在其它地方自杀不行?”

另外,查尔斯说,他从第三电视的画面看到,吉隆坡反贪委的办公室窗户很小,“一个大男人怎么跳出窗户”?

“因此,他的死引起很多疑窦,但是最重要的是,纳吉错了,赵明福和沙巴尼命案有很多相似之处,因为他们都是在政府部门、反贪委办公楼(死亡)。他们都在反贪委的监护下。不管死亡原因是什么,他们死亡的地点是政府部门,即反贪委,因此,反贪委必须负责任。”

另外,他和卡立沙末皆问道,警方宣称沙巴尼自行携带文件前往反贪委,那么这些文件是什么文件,现在又在哪里?

不接受自杀论

查尔斯呼吁政府设立皇家调查委员会,以调查沙巴尼的命案,并重振公众对反贪委的信心。马诺加然附和其说法,并要求国会下议院院长即刻批准紧急动议,以辩论赵明福和沙巴尼的命案及反贪委的调查程序。

查尔斯表示,关税局的跑腿告诉他,沙巴尼是一名好人、乐于助人,他们都不相信沙巴尼会自杀。

早前出席沙巴尼葬礼的卡立沙末表示,当地回教堂的负责人告诉他,沙巴尼是一名好人,且是虔诚的回教徒,在宗教司休假时,他会代替宗教司领导祈祷。

他说,根据回教,自杀者将直接入地狱,不能上天堂,因此“自杀”的说法不能被接受。

反贪委上周六(4月2日)宣布,反贪委追查槟州、雪兰莪、柔佛、彭亨的五个港口关税局官员,逮捕62名涉嫌舞弊案者,并缴获逾百万脏款。其中,被逮捕的雪州关税局有42人。

这些关税员疑涉及洗黑钱、逃税、不法献金等舞弊。被扣者当中有53名男性及9名女性,年龄介于24至56岁,其中一名是主任级官员。【点击:涉及未缴税款舞弊案  关税主管陈尸反贪委】

这宗继雪州行政议员欧阳捍华政治秘书赵明福命丧雪州反贪委总部大楼后,反贪污委员会再发生疑似坠楼命案引起巨大关注。

反贪委已经将两名反贪委官员停职,直到反贪委的内部调查完成为止。这两名反贪委官员被指违反指示,在证人还在反贪委办公楼范围内时,没有伴在证人身边。

首相署部长纳兹里说,政府会调查这起命案的起因,至于涉嫌贪污的关税局职员的调查工作也会继续下去。

Klang MP Charles Santiago claims he knows the identity of a senior Customs officer in connection with the death of the Selangor Customs Department assistant director.

KUALA LUMPUR: In a startling revelation, claims are emerging that a senior Customs Department officer may be connected to the death of his colleague, Ahmad Sarbani Mohamed.

Klang MP Charles Santiago said that he was informed of this by the freight forwarding agents in Port Klang.

“They think that Ahmad Sarbani’s death is connected to him (the senior officer),” he told reporters in Parliament.

Santiago said that he knew the identity of the senior Customs officer but refused to reveal it at this point in time.

The opposition MP said he was briefed in detail by the freight forwarding agents, whom he added were fond of Ahmad Sarbani, the Selangor Customs Department assistant director.

Ahmad Sarbani had fallen to his death from the third-floor of the Malaysian Anti-Corruption Commission (MACC) office in Jalan Cochrane here yesterday.

He was among 62 officers arrested in a joint operation in Penang, Johor, Selangor and Pahang by a special task force comprising MACC, the Inland Revenue Board, the Customs Department and Bank Negara.

International problem

Meanwhile, Santiago said that the government crackdown on the Customs officials has now put Malaysia’s trade situation at risk.

“The forwarders are protesting over the delay in the processing of documents after the MACC raid last week,” he said, referring to the Ops 3B operation that struck at Customs offices across the country.

Late last month, some 67 Customs officers were detained following government suspicions that they were involved in money-laundering and tax evasion activities.

Forty-seven of them, Santiago said, were Klang Customs officials. In response to the MACC swoop and prior to Sarbani’s death, Port Klang officials went on a “go-slow”.

Santiago said both the arrest of the officers and the slowdown had caused delays in document processing.

“It is a big issue because it involves a huge cost. Now the ships are waiting at the port, and they can’t unload. When the documents are not processed, they can’t move on to Singapore and Indonesia.”

“That has become a cost, and it is an international problem now,” he said.

According to Santiago’s Twitter account, more than 800 frieght forwarders protested at the North Port Customs building in Port Klang yesterday.

查尔斯(右图)表示,首相署部长纳兹里回答其国会书面回答中指出,反贪污委员会已仔细审读上述书籍,并发现当中不存在贪污行为的元素。

“纳兹里也说,由于没有触犯2009年《反贪污委员会法令》的根据,因此该委会不会开案调查此案。”

查尔斯今日在国会召开记者会上说,该书籍很清楚地显示,马哈迪当权时浪费高达1000亿元公币,并认为这是严重的贪污行为。

他也促请政府公开反贪污委员会审查该书籍的报告,以便显示政府打击贪污的透明度。

“若存在贪污,我们要知道贪污的行为如何进行,若没有贪污,我挑战政府起诉韦恩,以便证明马哈迪的清白。”

SHAH ALAM: Klang MP Charles Santiago has questioned the Malaysian Anti-Corruption Commission (MACC) for closing its investigation file on Transport Minister Ong Tee Keat.

He said the MACC’s move could be interpreted as protecting Ong from being linked to the Port Klang Free Zone (PKFZ) scandal.

Describing the MACC’s action as “disreputable”, he said Kuala Dimensi Sdn Bhd chief executive officer Tiong King Sing had surrendered all evidence linking Ong to the scandal to the MACC.

‘He (Tiong) has forwarded evidence that the money was passed on to a middle man and there was a witness who saw the money being handed to Ong.

“I am shocked at the MACC’s statement, “ he said today.

MACC had yesterday announced that it was closing its investigation file against Ong who is alleged to have received RM10 million from Tiong.

(Rumours has it that in the run-up to the Sibu by-election, several behind-the-scene deals have been struck to ensure BN wins the seat.

(The 60% Chinese votes are dependent on Tiong, who chairs the BN backbenchers club, and the power-wielding Lau family in Sibu, making peace.

(Robert Lau Hui Yew of Sarawak United People’s Party will face DAP’s Wong Ho Leng in the May 16 Sibu parliamentary by-election).

( It is understood that Prime Minister Najib Tun Razak is not prepared to risk losing the Sibu seat more so now that BN has wrested Hulu Selangor.)

Meanwhile, Ong, when met, confirmed that he had received a letter dated April 22 informing him that the MACC had no proof linking him to the allegations.

Last year, MACC quizzed Ong in relation to the PKFZ scandal and allegations that he received RM10 million from Tiong for MCA activities.

Ong was at the time MCA president, while Kuala Dimensi was the main contractor for PKFZ.

Media Statement by Democratic Action Party (DAP) Members of Parliament in Selangor, on 26 December 2009:

We urge the police to tackle crime with the same vigour they are putting in to intimidate and persecute Pakatan Rakyat leaders.

The move to investigate Penang Chief Minister and DAP secretary-general Lim Guan Eng for allegedly making seditious remarks during the Pakatan Rakyat convention in Shah Alam last weekend was of misguided priority as the public lives in fear as violent crimes are being committed every day.

Guan Eng’s statement cannot be deemed as unsubstantiated remarks as he was only echoing the conclusion of the acclaimed Thai forensic pathologist Dr Porntip Rojanasunan, who attended the second post mortem on Teoh Beng Hock last month as an observer, that there was an 80% possibility of homicide in Beng Hock’s death.

We want to remind Selangor police chief Datuk Khalid Abu Bakar that Guan Eng was only repeating what millions of people in the country and the world are saying.

If Guan Eng’s statement that Beng Hock had been cruelly murdered is “unsubstantiated” and need to be investigated under Sedition Act, then why the police did not initiate sedition investigation against Datuk Seri Nazri Abdul Aziz who said Beng Hock “nak terjun bangunan itu” and Malaysian Anti-Corruption Commission Chief Commissioner Datuk Seri Ahmad Said who said Beng Hock had committed suicide? Are they statements substantiated by any solid facts?

PDRM should be putting more resources into tackling real rather than imaginary criminals.

The discovery of the body on Wednesday of yet another child believed to have been sexually violated before being murdered is a chilling reminder we need more frontline police officers and not pen-pushers.

Words don’t kill; killers do. Datuk Khalid Abu Bakar need to be reminded that PDRM should take care of the interest of rakyat, not the interest of MACC and/or BN.

民主行动党雪州国会议员于2009年12月26日在八打灵再也发表的联合文告:

纳兹力和阿末赛益说明福自杀没事;林冠英为何不能附和普缇的讲法?

雪州总警长卡立表示要援引煽动法令对付发表明福被杀言论的槟城首长林冠英,我们对此表达强烈抗议。

林冠英只是附和泰国法医普缇在日前提出的“明福是80%被杀”的结论,同时也没有任何迹象显示林冠英发表了这项言论后人民情绪被煽动,反倒是卡立杞人忧天,竟然自己去报案指控林冠英,政治动机非常明显。

其实打自明福坠楼事件发生以来,警方就一直是以自杀的角度展开调查,完全不肯正视明福是有惨遭他杀的可能性。直到普缇在验尸庭上供证,指出明福确实是有80% 的可能性是被他杀。民主行动党在普缇做出明福是有可能遭到他杀的结论后,曾经到警局报案,要求警方不能只以自杀的角度来调查明福案件,更应该以他杀的角度来调查,然而警方至今却没有任何的行动,让人民失望不已。

我们要提醒卡立,不只是林冠英附和普缇的结论,大部分人民也对普缇的结论也是深信不疑。警察应该是人民的保姆,而不是反贪会或者国阵的保姆。

我们也要质问卡立,如果林冠英发表明福他杀的言论需要被调查,为何警方又对纳兹里在明福死后所发表的“我怎知道他会跳楼”的言论以及反贪污委员会主席阿末赛益把赵明福的死因,归咎于承受不了调查压力而自杀的言论视若无睹呢?难道纳兹里和阿末赛益的言论就是属于有根有据?

因此,我们要求雪州警方即刻撤销对林冠英的指控,并以公正和专业的角度处理明福案件,好让案件水落石出。

KUALA LUMPUR, Dec 1 (Bernama) — The Malaysian Anti-Corruption Commission (MACC) will investigate the land deal in Kampung Jalan Papan and Kampung Bukit Kerayong, Pandamaran, Klang.

Minister in the Prime Minister’s Department Datuk Seri Mohamed Nazri Aziz said there were elements of abuse of power in the land acquisition process from the residents to the developer.

He said representatives from the two villages had lodged a report to the MACC on Sept 2 but until today they had not been informed of its development.

“I will get in touch with MACC deputy chief commissioner Datuk Abu Kassim Mohamed to ensure that action is taken based on the report,” he told reporters after receiving a memorandum from resident committees from the two villages at the parliament lobby here on Tuesday.

The Kampung Jalan Papan land issue emanated in 1997 when six lots of the land in Pandamaran, including in the two villages were acquired by TPPT Sdn Bhd, a subsidiary of Bank Negara, to revive a stalled housing project.

In 2003, the Klang Municipal Council (MPK) issued a notice to the residents to vacate the land and shift to low-cost flats built by TPPT or other developers besides getting a RM7,000 compensation.

However, most of the villagers were not happy with the deal and counter-proposed to TPPT to build houses costing below RM100,000 for them, arguing that they had occupied the land for the past 70 years and held temporary occupancy permit (TOL) until it was revoked in 1990 without any explanation.

The issue erupted in 2004 when the MPK tore down houses in both villages under the Emergency Ordinance, forcing the two village committees to seek injunctions to stop the demolition and better terms including being given terrace houses.

In 2007, TPPT appointed Melati Ehsan Development Sdn Bhd to develop the project and the company set out to build 107 units of one and half storey terrace houses below RM100,000 but only 51 houses would be allotted to the villagers.

Mohamed Nazri said TPPT had breached an agreement endorsed by the Selangor government by awarding the project to Melati Ehsan, whereas the agreement specified that a Bank Negara subsidiary must not be involved in a profitable venture except for to build houses for the poor.

Mohamed Nazri said he would pursue the matter with Bank Negara governor Tan Sri Dr Zeti Akhtar Aziz.
