A group of 80 angry residents marched to the Tabung Projek Perumahan Terbengkalai (TPPT) office to hand over a memorandum to protest eviction from their homes.

NONEThe residents of Kampung Jalan Papan and Kampung Bukit Kerayong in Pandamaran, Klang claimed that TPPT has taken land meant for new homes for them, and sold it to construction company Melati Ehsan Holdings Bhd for a profit of RM18 million.

Now they are being evicted from their homes because Melati Ehsan is planning to build houses and shoplots on the site.

The villagers carried banners proclaiming that they had been ‘cheated’, as well as calling on Bank Negara governor Zeti Akhbar Aziz to look into TPPT.

NONEVillage committee chairman Ang Mah Chye (left) said that TPPT, a subsidiary of Bank Negara, is responsible for developing low-cost houses for the poor.

It is stipulated that TPPT is not allowed to make any profit, sell or mortgage the land to third parties without the permission from Klang Municipal Council (MPK), he said.

Klang parliamentarian Charles Santiago led the villagers into the TPPT office. They were met by security guards and police who told the group to disperse.

After negotiations, a few representatives were allowed to enter the managing director’s office to hand over their memorandum.

NONESantiago (extreme left in photo) said it was disappointing that the memorandum was handed to a lower-ranking officer instead of TPPT managing director Hidzir Yahya.

TPPT, he said, is a government agency and should therefore be answerable to the people.

“How can the Barisan Nasional government say that people are their priority when (officials) refuse to meet us even when they are in their office?” asked the Klang MP.

Santiago added that the memorandum is to remind the agency of its responsibilities to the people and to assist the marginalised villagers.

Ang told reporters that if TPPT does not either reply or take action in two weeks, the villagers will take their grouses to Bank Negara.

Allegations of corruption

Prior to the protest, the villagers had sent a memorandum to Minister of the Prime Minister’s department Mohamed Nazri Abdul Aziz and to the Malaysian Anti-Corruption Commission (MACC), calling on them to look into possible corruption.

This prompted Nazri to urge the MACC to investigate the dispute.

NONEThe villagers claimed that their land was taken over by the TPPT in 1997 with the promise that low-cost houses would be built for them.

However, about six years ago MPK used the Emergency Ordinance to vacate the land.

The two village committees have since sought injunctions to stop demolition work on the disputed site.

The villagers claimed that they are not squatters but ‘pioneers’, as the 9,000 villagers had originally settled in Jalan Papan and Bukit Kerayong 70 years ago.

【本刊翁慧琪撰述/苏晓枫摄影】假 设国家银行子公司——废置房屋计划基金私人公司(TPPT Sdn Bhd)仍然没有任何交待,巴板路搬迁委员会主席洪马再表示,他们会在两周后率众去到国家银行前示威,而巴生国会议员查尔斯圣地亚哥(Charles Santiago)更放话,到时候会带领上千人一同宣泄不满。

约50名巴生巴板路(Jalan Papan)和武吉哥拉容(Bukit Kerayong)两地遭迫迁的居今天直击废置房屋计划基金私人公司位于吉隆坡的办公楼呈交备忘录民,要求该公司给他们一个交待。

然而,他们呈交备忘录的过程并不顺利。在该公司董事经理不在场的情况下,他们只能把文件委托给公司职员。

查尔斯圣地亚哥(右图打红领带者)表示,他感到相当失望,因为董事经理不在办公室,没办法现场交给他,不过他直指对方就算在,也不会愿意接见。“我们还没有完成任务。假若仍没有下一步发展,我们将会再次到来。不会只有这样(约50人),那时候会有千人到来。”

居民给基金公司两周时间

巴板路搬迁委员会主席洪马再表示,他们要提醒废置房屋计划基金私人公司,必须为民负责;而若该公司继续对此事不闻不问,他们将在至少两周后采取行动,即动身前往国家银行。居民已经多次呈交文件给废置房屋计划基金私人公司,但却迄今到毫无下文。

洪马再(左图右)与武吉哥拉容搬迁委员会主席徐志荣两人表示,他们在12月7日,接获法庭致函指居民已经非法进入别人土地,更以“抢夺土地”的字眼形容居住在当地超过50年的人民,更要求他们在12天里撤离该地。这已经是他们第三次收到这类文件。

此 外,两人还透露,他们在9月2日向反贪污委员会报案,尽管在约一周后,有两名官员到他们府上了解详情,过后也就宣告无声无息。根据《马新社》在12月1日 的报道,首相署部长纳兹里(Nazri Aziz)曾提及此案,认为收购土地的过程中的确含有滥用权力的成分,更承诺会向现任反贪委副主席阿布卡欣(Abu Kassim Mohammad)查询,不过他们迄今仍未获悉有任何发展。

两地总人数超过千人的城市拓荒者早在70年前已开垦红树林区,推平土地建立自己的家园,有些家庭已三代居住在巴板路和武吉哥拉容。

当 地的华、印裔居民在早上10时20分左右,就开始于隆雪华堂门口前集合,部分人士还身穿印有“帮帮巴板村打倒地霸”的上衣。洪马再、徐志荣(右图),以及 巴板路居协主席洪文泰,在场先为居民作简短解释后,约10时45分,超过50人的团队即出发,徒步往苏丹苏莱曼路(Jalan Sultan Sulaiman)的回教保险金融广场(Dataran Kewangan Darul Takaful),也就是废置房屋计划基金私人公司办公室的所在地。

高喊遭基金公司欺骗

他 们一行人在五分钟后到达,查尔斯圣地亚哥也加入男女老少约50人的阵容,举起写着“Zeti,Kampong Kita Diniaga”、“TPPT Untung RM18Juta, Melati Ehsan Untung RM150Juta”的布条,更高喊“我们被废置房屋计划基金私人公司欺骗”(TPPT Tipu Kita)的口号。

到早上11时的时候,他们打算上楼到公司呈交备忘录,却被保安人员拒于门外,不过敌不过人多势众的团队,五分钟后他们就上到五楼要求见公司董事经理。员工称主管不在,导致局面暂时陷入僵局。

大 概早上11时40分,数名职位更高的警官到场后,双方终算达成协议,派出查尔斯圣地亚哥、洪马再、徐志荣,以及武吉哥拉容搬迁委员会秘书马慈伦,去到办公 楼上层,呈交备忘录给该公司的董事经理希兹雅亚(Tuan Haji Hidzir Yahya),其它居民则下到一楼等待。然而,其秘书向他们表明董事经理不在,所以四位代表只好把备忘录交到一位名为纳沙鲁丁(Nazaruddin)的 职员手中。

查尔斯圣地亚哥等人约20分钟后就下来,向围上前来的居民作讲解。中午12时左右,示威居民就乘坐数量轿车和一辆学校巴士离开, 剩下数名代表在场少作讨论。今天到场支持居民行列的非政府组织,包括受压迫人民阵线(Jerit)、马来西亚人民之声(Suaram)、马来西亚社会主义 党(PSM)以及隆雪华堂。

居民遭紧急法令迫迁

查尔斯表示:“我不否认我们需要发展,但发展必须是以人民为中心出发。”他强烈批评,土地拥有者废置房屋计划基金私人公司,以3200万元的价格售卖这片的土地,给上市公司亿成控股(Melati Ehsan Holdings)。

买 入此地的亿成控股估计,这项房屋计划将为该集团带来1.5亿元的盈利,但废置房屋计划基金私人公司却坚称对方只是发展商。居民认为两家公司获利不少,却仅 给每家人7000元的赔偿金,更援引《1969年紧急法令》(Emergency Ordinary)逼迫拥有临时地契数十年的他们搬迁。
查尔斯也表示,这明显已违反州政府开出的条件,既这项房屋计划不能以谋利为导向,反之该专注于解决社会问题。他也指出,这项计划违反国家银行成立该基金的目的——提高人民拥有房屋的能力和提升低收入群体的生活水平。

KUALA LUMPUR, Dec 1 (Bernama) — The Malaysian Anti-Corruption Commission (MACC) will investigate the land deal in Kampung Jalan Papan and Kampung Bukit Kerayong, Pandamaran, Klang.

Minister in the Prime Minister’s Department Datuk Seri Mohamed Nazri Aziz said there were elements of abuse of power in the land acquisition process from the residents to the developer.

He said representatives from the two villages had lodged a report to the MACC on Sept 2 but until today they had not been informed of its development.

“I will get in touch with MACC deputy chief commissioner Datuk Abu Kassim Mohamed to ensure that action is taken based on the report,” he told reporters after receiving a memorandum from resident committees from the two villages at the parliament lobby here on Tuesday.

The Kampung Jalan Papan land issue emanated in 1997 when six lots of the land in Pandamaran, including in the two villages were acquired by TPPT Sdn Bhd, a subsidiary of Bank Negara, to revive a stalled housing project.

In 2003, the Klang Municipal Council (MPK) issued a notice to the residents to vacate the land and shift to low-cost flats built by TPPT or other developers besides getting a RM7,000 compensation.

However, most of the villagers were not happy with the deal and counter-proposed to TPPT to build houses costing below RM100,000 for them, arguing that they had occupied the land for the past 70 years and held temporary occupancy permit (TOL) until it was revoked in 1990 without any explanation.

The issue erupted in 2004 when the MPK tore down houses in both villages under the Emergency Ordinance, forcing the two village committees to seek injunctions to stop the demolition and better terms including being given terrace houses.

In 2007, TPPT appointed Melati Ehsan Development Sdn Bhd to develop the project and the company set out to build 107 units of one and half storey terrace houses below RM100,000 but only 51 houses would be allotted to the villagers.

Mohamed Nazri said TPPT had breached an agreement endorsed by the Selangor government by awarding the project to Melati Ehsan, whereas the agreement specified that a Bank Negara subsidiary must not be involved in a profitable venture except for to build houses for the poor.

Mohamed Nazri said he would pursue the matter with Bank Negara governor Tan Sri Dr Zeti Akhtar Aziz.

KLANG – Settlers who have been asked to vacate their homes to make way for a housing project at  Jalan Papan and Bukit Kerayong in Pandamaran, near here,  will take the issue to the Malaysian Anti-Corruption Commission.

They plan to be at the MACC office on Wednesday to file a report against TPPT Sdn Bhd over an alleged mishandling of a land issue that has purportedly affected their status as the rightful settlers there.

bkt-kerayong-4.jpgThe settlers do not want the fate that befell on the villagers in Kampung Buah Pala in Penang to also happen to them.

Like the Buah Pala settlers, the folks at Jalan Papan and Bukit Kerayong have also become victims of urban redevelopment and have been asked to clear out of their homes to make way for a mixed housing project in their area.

Deadlines have passed

The villagers were first asked to vacate the land by July 31. This was then extended to Aug 8.

The two deadlines have passed and the settlers are adamant about staying put on their land, which had been passed through the genrations since the first pioneeers cleared the wilderness there over 70 years ago.

“Our families have been living there for decades, our ancestors used their own savings to develop this place and now.. we are asked to move out to make way for a multi-million housing project,” said Jalan Papan and Bukt Kerayong action committee chairman Ang Mah Chye.

He said they will not budge and have started on a signature campaign to garner support for their cause.

Ang and his deputy, Dominic See, led the first phase of the campaign at the Pandamaran morning market on Aug 30; the eve of the country’s 52nd National Day.

They will carry out the signature campaign every week and, armed with the support of the people, will file a petition with the relevant authorities to reinstate the lands in their hands.

TPPT set up to benefit rakyat

They also intend to get the MACC to investigate TPPT Sdn Bhd, which was originally entrusted by the Abandoned Housing Project Fund to revive incomplete housing projects and develop affordable homes for various target groups.

TPPT, however, has allegedly sold the deal to development company Melati Ehsan Holdings Bhd for RM32mil and the company then drew up a plan for a proposed ‘Taman Ehsan Jaya’ that can potentially generate for it a revenue of RM150mil.

“TPPT was not established for monetary profit but for the benefit of the Rakyat. They were not honouring their agreement.

“The amount of RM150mil clearly showed their actions are not in line with the objective of TPPT, which was established to assist the lower income group rather than the middle or higher income.

“They should build more houses are affordable for the target groups,” he added.

Getting Zeti to intervene

Ang said they also hope to meet Bank Negara governor Zeti Akhtar Aziz and to get her to intervene in the matter, since the central bank is responsible for the setting up of TPPT in 1990.

“I hope the Bank Negara governor will hear the plight of the settlers and will call for a more considerate initiative by the developer in resolving the issue and to put the development project on hold,” he said.

The settlers hope their land, allegedly taken away from them, will be returned and they will also be given permanent land titles.

bkt-kerayong-5.jpgThey also plead not to be driven out from their homes until further discussions are held between the state government, residents and developer and an amicable solution is found.

In addition, they hope that the plan to build a hypermarket at Bukit Kerayong will be scrapped.

The settlers also hope the MACC will charge the culprits, if any impropriety is found, and penalize them.

Supporting their cause

Klang MP Charles Santiago who had been supporting the settlers’ cause said  it was ‘inhumane’ to shove the families that had stayed there for over 70 years and  who were responsible for clearing the jungles and swamps there to make the village suitable for decent living.

“It is disheartening to see the Bukit Krayong families fighting for their land through campaigns.

“ The prime minister talks about ‘1Malaysia’ that puts the people first. In this case, the people have been sidelined.

“For me, there is an element of impropriety and I will accompany the action committee to lodge a report on TPPT at the MACC tomorrow (Wednesday),” he said.
