Pendedahan yang dibuat oleh Ahli Parlimen Bintulu dan CEO syarikat kontraktor utama projek PKFZ, Kuala Dimensi Sdn Bhd, Tiong King Sing memberi kesan yang serius terhadap keyakinan yang dibina melalui 1Malaysia yang dibawa oleh Perdana Menteri Najib Tun RazaK.

Ia memberi kesan yang besar terhadap keyakinan yang dibina di kalangan ahli perniagaan tempatan dan asing.

Ia mempersoalkan tentang amalan perniagaan di negara ini, tentang bagaimana hal ehwal urusniaga dilakukan, dilindungi dan dipromosikan.

Pendedahan mengejutkan yang dibuat oleh Tiong bahawa beliau telah memberikan ‘derma’ sebanyak RM10 juta kepada Presiden MCA dan Menteri Kewangan Dato’ Seri Ong Tee Keat menjadikan skandal PKFZ semakin rumit.

Apa yang mengejutkan mengenai pendedahan tersebut ialah derma tersebut dibuat atas pemintaan Ong, di mana kementeriannya meneliti penyiasatan skandal yang melibatkan dana RM12.5 bilion itu.

Hal ini jelas merupakan penerusan hubungan intim dan berharga antara ahli pernianagaan dengan kerajaan sebagaimana terserlah di zaman bekas perdana menteri Dr Mahathir Mohammed.

Artikel Malaysiakini mendedahkan seterusnya bahawa wang tersebut dibayar dalam bentuk tunai untuk tiga kali pembayaran sewaktu mesyuarat diadakan di Petaling Jaya dan Kuala Lumpur dalam 2008.

Malah Tiong mengatakan bahawa dia mempunyai kawan yang menyaksikan pemberian tersebut dibuat.

Tiong juga memberi amaran bahawa jika menteri berkenaan menafikan pemberian ‘derma’ itu, beliau akan tolong mengingatkan Presiden MCA itu di mana pemberian itu dibuat.

Pendedahan Tiong itu turut menjelaskan tentang kepentingan bersama di antara dua orang tersebut. Dalam hal ini Tiong mungkin telah terlepas pandang dengan mengatakan terdapat usaha tolong menolong di antara kedua belah pihak.

Perkataan sebenar yang diungkapkan Tiong (sebagaimana dilaporkan media) ialah: “Saya sepatutnya memulangkan wang tersebut kepada orang lain. Tetapi untuk menolong satu sama lain, saya biarkan Ong menggunakan wang itu dahulu”.

Apakah yang dimahukan oleh Tiong sebagai ahli perniagaan daripada Ong? Apakah yang boleh ditawarkan oleh Ong kepada Kuala Dimensi atas kapasitinya sebagai menteri? Elemen bersama antara Tiong dan Ong dalam 2008 ialah PKFZ.

Persoalan yang bermain di minda rakyat Malaysia kini adalah seperti berikut: Adakah pemberian RM10 juta Tiong itu merupakan satu perbuatan yang boleh disifatkan sebagai rasuah? Dan apakah bahagian Ong dalam percaturan ini? Apakah yang diharapkan daripada pemberian ini?

Pendedahan ini dibuat sehari selepas pengerusi Pihak Berkuasa Pelabuhan Klang (PKA) Lee Hwa Beng membuat laporan polis terhadap KDSB, yang dituduh membuat tuntutan melambung tinggi, tuntutan tidak sekata serta beberapa kepincangan melibatkan sekurang-kurangnya RM500 juta hingga RM1 bilion.

Kuala Dimensi Sdn Bhd dilantik oleh Pihak Berkuasa Pelabuhan Klang (PKA) sebagai kontraktor utama bagi pembangunan projek PKFZ bernilai RM1.32 bilion. Syarikat yang kontroversi itu juga dituduh mengaut keuntungan daripada penjualan tanah kepada Pihak Berkuasa Pelabuhan Klang, yang menyaksikan peningkatan harga daripada RM3 bagi satu kaki persegi dalam 1999 kepada RM25 sekaki persegi dalam 2002.

Kita tidak berminat dengan soal persahabatan di antara Ong dan Tiong, begitu juga dengan penggunaan jet peribadi. Orang ramai ingin tahu sama ada terdapatnya usaha sama di antara Ong dan Tiong untuk menutup skandal RM12.5 bilion yang melibatkan duit pembayar cukai itu ataupun sebaliknya.

Selanjutnya, adalah mengejutkan apabila negara ini tidak punya badan pemantau yang benar-benar berwibawa untuk menyiasat ibu kepada segala skandal ini. Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) yang sepatutnya menyiasat skandal tersebut, ternyata gagal berbuat demikian walaupun badan itu sudah mendapatkan semua dokumen perlu daripada PKA dalam 2007 dan telah menerima banyak aduan.

Apa yang kita dapat hanyalah pendedahan skandal dalam skandal kewangan, yang mempunyai elemen amalan penipuan. Apa yang sangat malang, negara ini tidak mempunyai Suruhanjaya Anti-Rasuah yang benar-benar bebas untuk menyiasat pendedahan termasuk skandal yang berlaku.

Setakat ini SPRM hanya menjadi kuda tunggangan Najib untuk meruntuhkan kerajaan Pakatan Rakyat Selangor.

Keyakinan rakyat terhadap SPRM pada masa ini benar-benar rendah berikutan kematian Teoh Beng Hock.

Jadi, apakah cara penyelesaiannya?

Jawapannya mungkin berada di tangan 42 orang Ahli Panel Penasihat SPRM. Mereka harus membuat tuntutan secara kolektif supaya SPRM dibiarkan benar-benar bebas untuk menyiasat kes kematian Teoh dan skandal RM12.5 bilon PKFZ. Kumpulan ini perlu meletakkan jawatan beramai-ramai sekiranya terdapat penyiasatan yang tidak bebas.

Saya juga mendesak Hajib supaya meminta Ong dan pengerusi Kelab Penyokong Barisan Nasional bercuti sehingga semua kerja siasatan selesai.

DAP juga meminta kepada Najib, jika terdapat sesiapa yang akan dipecat setelah pendedahan laporan audit PWC itu, maka Najib perlu memberikan jawapannnya kepada rakyat.

民都鲁国会议员暨巴生港口自贸区主要承包商Kuala Dimensi首席执行员张庆信对首相纳吉的一个大马的信心建构有重要的贡献。

他最近的揭露破坏国内外商业对我国的信心。我国的商业手法备受质疑,国家的利益并不获得保障和置于首位。

张庆信在《当今大马》作出惊人揭露。他表示曾给予马华总会长暨交通部长翁诗杰一千万令吉的‘捐款’,已把这个丑闻暴露到令人头昏目眩的复杂层次。

令人震惊的是,该捐款被指是在翁诗杰的要求下拨出,而翁诗杰负责的交通部正监督价值125亿令吉巴生港口自贸区丑闻的调查。

这种商业和政府如鱼得水的良好关系,在前首相马哈迪任内普遍发生,至今依然持续。

《当今大马》的新闻透露,该笔‘捐款’分三次以现款方式在八打灵再也和吉隆坡转交给翁诗杰。

张庆信声称他有一个朋友可见证该笔款项的移交。

张庆信也警告,如果翁诗杰否认收到该笔‘捐款’,他将清楚告诉翁诗杰在什么地点把这笔钱交给他。

张庆信有如氢弹威力的宣布,透露两人具有的共同利益。张庆信不经意地泄露他的‘捐款’将会获得补偿。

张庆信原来的话是这些钱我本来是要还给人家的,但是基于大家互相帮忙,我先给你用。(作者强调)

商人张庆信要从翁诗杰处获得什么?翁诗杰以部长的职权,能够为Kuala Dimensi提供什么?张庆信和翁诗杰在2008年的共同关系是巴生港口自贸区。

在大马人脑中的问题是,张庆信的一千万令吉‘捐款’是否构成贪污?翁诗杰是否涉及枱底交易?交易内容是什么?

这些揭露在巴生港务局主席李华民报警一天后发生,Kuala Dimensi被指虚报帐目,超额索款,不正常的索款,帐目有所出入,以及怀疑高达5亿令吉至10亿令吉的欺诈。

Kuala Dimensi被巴生港务局委任为价值13.2亿令吉的巴生港口自贸区发展计划的主要承包商。这个极具争议性的公司被指从售卖土地给巴生港务局中谋取暴利,Kuala Dimensi在1999年以每方尺3令吉购买该片土地,在仅仅三年之后,以每方尺25令吉售卖给巴生港务局。

我们对翁诗杰和张庆信之间的友情和私人飞机的使用没有兴趣,人民要知道翁诗杰和张庆信之间是否有枱底交易,以掩盖这个损害纳税人利益和价值125亿令吉的丑闻。

更令人羞耻的是,我国竟然没有一个真正的监督机构可以找出这宗大马历史上最大丑闻的真相。彻查这个丑闻本是大马反贪委员会的职责,但是反贪委员会自2007年从巴生港务局取得所有资料和接到无数投诉后,依然无法给人民一个交代。

现在我们面对张庆信揭露的金钱丑闻,其中或有欺诈的成分。不幸的是国内没有独立的反贪委员会可以公正无私地调查这个新丑闻。

目前反贪委员会已成了纳吉颠覆雪州民联政府的主要工具。

赵明福之死使公众对反贪委员会的信心降至最低。

所以,我们有什么解决方案?

答案或许在反贪委员会42个顾问成员手上。他们应该集体要求反贪委员会对张庆信的揭露和巴生港口自贸区丑闻展开独立的调查。如果无法达成,这些顾问应该全体辞职。

我也呼吁纳吉指示翁诗杰和国阵后座议员俱乐部主席张庆信请假,直到所有调查完成。

民主行动党已经多次询问纳吉,在普华永道的稽查报告公布后,纳吉会否找出‘真凶’并‘斩首’示众?纳吉欠全国人民一个交代。

Press Statement by Member of Parliament Klang Charles Santiago in Klang on 13 August 2009

The revelation by Bintulu MP and PKFZ turn- key contractor Kuala Dimensi CEO Datuk Seri Tiong King Sing has critical ramifications for confidence building in Prime Minister Najib Tun Razak’s 1Malaysia.

It has adverse implications for confidence building among local and foreign business. It questions business practices in the country in the way business is done and affairs and interests of the country, protected and promoted.

Tiong’s startling revelation in Malaysiakini that he had given a RM10 million ‘donation’ to MCA President and Transport Minister Datuk Seri Ong Tee Keat has exposed the scandal to a dizzyingly complex level.

What is shocking about the revelation is that the donation was made at the request of Ong, whose ministry was overseeing the investigations surrounding the RM12.5 billion PKFZ fiasco.

This is clearly a continuation of the cosy relationship between business and government as prevalent under ex-premier Dr Mahathir Mohammed.

The Malaysiakini article further reveals that the money was paid in cash over three instalments during meetings held in Petaling Jaya and Kuala Lumpur in 2008.

In fact, Tiong notes that he has a friend who witnessed the transactions.

Tiong has also warned Ong that if the Minister denies the ‘donation’ transaction, then he will  refresh the MCA President’s  memory in relation to where the money was given.

Also, Tiong’s outbursts reveal a common interest between the two men. In this regard Tiong might  have inadvertently spilled the beans when he suggested that there was a quid-pro-quo in the ‘donations’ transaction.

Tiong’s exact words (as reported by the media) is – “I was supposed to return the money to some other people. But in order to help each other, I let Ong use the money first”. (emphasis added by author)

What did businessmen Tiong want from Ong? And what could Ong offer Kuala Dimensi in his capacity as a Minister? The common element between Tiong and Ong in 2008 is the  PKFZ.

The question in the mind of all Malaysians is the following: did Tiong’s  RM10 million constitute an act of corruption? And what was Ong’s part in this arrangement? What was the bargain?

These revelations come just a day after Port Klang Authority (PKA) Chairman Lee Hwa Beng filed a police report against KDSB, which has been accused of making inflated claims, over-billing, irregular claims, discrepancies and  possibility of fraud amounting between RM500 million and RM1 billion.

Kuala Dimensi Sdn Bhd was appointed by Port Klang Authority (PKA) as turn key developer for PKFZ development project worth RM1.32 billion. The controversial company was also accused of profiting from the land sale to Port Klang Authority, which witnessed a price hike from RM3 per square feet in 1999 to RM25 per square feet in 2002.

We are not interested in the friendship between Ong and Tiong nor the use of the private jet. The people want to know if there were exchanges between Ong and Tiong for the cover-up of the RM12.5 billion scandal which hits tax-payers’ pockets.

Furthermore it is shocking that the country does not have a real watch dog for the mother of all scandals. The Malaysian Anti Corruption Commission (MACC), which was supposed to probe into the scandal, has failed to do that even though the body has seized all necessary documents from PKA in 2007 and received lots of complaints.

What we have is a scandalous revelation within a financial scandal, which has elements of fraudulent practices. And what is unfortunate is that the country does not have an independent Anti Corruption Commission that could probe the revelations including the scandal without fear or favour.

And at present the MACC has become Najib’s pit bull to de-legitimize the Pakatan Rakyat-led state government of Selangor.

The public confidence on MACC is at an all time low since the death of Teoh Beng Hock.

So, what then is the solution?

The answer might be in the hands of the 42 Advisory Panel Members of the MACC. They should collectively demand that MACC undertakes an independent investigation on Tiong’s revealations and the larger PKFZ RM12.5 billion fiasco. The group should resign en-msse in the event there are no independent investigations.

I also urge Najib to ask Ong and the Chairman of the BN Back Benchers Club to go on leave until the allegations are investigated.

The Democratic Action Party (DAP) has been asking Najib, if heads would roll, since the disclosure of the PwC audit report. Najib owes the nation an answer.

KUALA LUMPUR (June 17, 2009) : Charles Santiago (DAP-Klang) said Prime Minister Datuk Seri Najib Abdul Razak’s written reply, hinting that no action would be taken against former transport ministers and Port Klang Authority (PKA) chairman Datuk Chor Chee Heung over the Port Klang Free Zone (PKFZ) multi-billion ringgit scandal, is “most unsatisfactiory”.

Replying to Santiago’s question whether action would be taken against those involved in the scandal, Najib said a task force had been set up by the Transport Ministry to come up with proposals in two months to ensure that mistakes in PKFZ did not recur.

Santiago said: “The reply means there will be no action taken against all of them. That means the wrongdoers and the people who abused their power will now be completely forgiven (as) now the government had clearly said that the way forward is based on the PricewaterhouseCoopers (PwC)’s report and the solution is the recommendations made by the task force.”

Speaking to reporters in Parliament lobby, Santiago said Chor, a deputy finance minister, was the non-executive deputy chairman of Wijaya Baru Global Bhd from 2004 to 2007 and PKA chairman from 2007 to 2008.

“He was wearing two hats at a time and the report showed that he did not declare his position or withdraw himself when the interest of the company was involved.

“Clearly there is a conflict of interest … I think the DAP’s proposal, calling for a royal commission to uncover the biggest scandal in Malaysia is a must because it is the only proper body to investigate this matter,” he said.

Lim Kit Siang (DAP-Ipoh Timur) said the public had expressed skepticism that the committee on corporate governance on PKFZ, headed by Transparency International (TI) president Paul Low, would be able to probe and get to the bottom of the scandal because Low was a MCA life member and former chairman of a MCA think-tank (Institute of Strategic Analysis and Policy Research) when Tun Dr Ling Liong Sik was party president.

“I am prepared to give Low a chance to prove that he ‘walks the talk’ on integrity as TI president. My question to Transport Minister Datuk Seri Ong Tee Keat is whether his choice of Low as the chairman of the committee was in any way influenced by Low’s MCA past, and what guarantees he can give that Low will be given full powers to probe into all abuses of power, conflicts of interest, malpractices and corruption resulting in the scandal,” he asked.

By Shannon TeohKUALA LUMPUR, June 17 — DAP is claiming that a combination of disclaimers will block anyone from being brought to book over the RM12.5 billion Port Klang Free Zone (PKFZ) scandal.

Its parliamentary leader Lim Kit Siang questioned the effectiveness of Transport Minister Datuk Seri Ong Tee Keat’s instructions that the report on the industrial zone, which began as a RM2 billion project, be submitted to the Malaysian Anti-Corruption Commission (MACC) and the Public Accounts Committee (PAC).

The Ipoh Timur MP cited a clause in the PricewaterhouseCoopers (PwC) report which states that “you are not authorised to use or rely on the report to arrive at any conclusion.”

“Then why did Ong direct the Port Klang Authority (PKA) chairman Datuk Lee Hwa Beng to submit copies to the MACC and PAC, if not just as a cynical publicity exercise?

“Why did Ong rely on the report to set up a task force and two committees as follow-up action on the report?” he asked.

The three teams were set up last week to offer recommendations on how to proceed with the PKFZ controversy with the task force given two months to recommend any action to be taken by the government.

Charles Santiago (DAP-Klang) also added that the report specifically states that “no investigation was conducted and PwC was not involved in uncovering any corruption or wrongdoing.”

His question in Parliament to the Prime Minister’s Department on whether any action would be taken against those involved in the PKFZ scandal only resulted in a written reply stating that the task force would put forward any recommendations.

“The government is clearly saying that any wrongdoing has been forgiven and it is you and I who will bear the cost of this scandal,” he said.

Lim also expressed his scepticism over the appointment of Datuk Paul Low, president of Transparency International Malaysia, to head a PKA committee on corporate governance.

“Low is an MCA life member and former chairman of an MCA think-tank when Tun Dr Ling Liong Sik was MCA president,” he said, referring to the fact that Ling has also been linked to the scandal.

Ling had approved letters of guarantee that allowed PKFZ’s turnkey developer Kuala Dimensi to raise billions in bonds under the guise of government-backed bonds.

However, such letters can only be issued by the Treasury and not the transport minister, as Ling had done when he held the Cabinet post.

Lim has also been calling for Datuk Seri Azmi Khalid to step down from as PAC chairman during its inquiry into the Port Klang issue.

He cited conflict of interest on Azmi’s part as he was a Cabinet minister from 2004 to 2008, at which time the Cabinet made crucial decisions regarding PKFZ, including approval of guarantee letters such as those signed off by Ling.

Instead, Lim wants Tan Seng Giaw, who is deputy chairman for both DAP and PAC, to step in for him.
