மக்கள் அச்சத்தில் நடமாடுகின்றனர் – மலேசிய பாதுகாப்பான நாடா?? –  சார்ல்ஸ் கேள்வி

நாட்டில் குற்றச் செயல்கள் குறைந்துள்ளன. பொது மக்கள் பாதுகாப்பான நிலையில் உள்ளனர் எனும் உள்துறை அமைச்சின்  கூற்றும் மறுபக்கம் என்.கே.ஆர்.ஏ குற்றவியல் புள்ளிவிவரங்களும் உண்மைக்கு புறம்பாக உள்ளது என குற்றம் சாட்டினார் கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ.

கடந்த ஆண்டு (2011) ஜனவரி முதல் மே வரையில் 70, 343 குற்றவியல் செயல்களும் இவ்வாண்டு (2012) ஜனவரி முதல் மே வரையில் 63,221 குற்றச்செயல்கள் நிகழ்ந்துள்ளதாக பெமாண்டு வெளியாக்கிய அறிக்கை ஒன்று கூறுகின்றது. அதாவது, கடந்த ஆண்டு (ஜனவரி – மே) காட்டிலும் இவ்வாண்டு மே வரையில் குற்றவியல் செயல்கள் 10.1% குறைந்துள்ளதாகக் கூறும் அதே வேளையில், தெரு குற்றங்கள் 43.0% குறைந்துள்ளதாக அக்குறியீடு கூறுகின்றது.

இது உண்மைக்கு புறம்பானது எனக் கூறிய சார்லஸ், நாட்டில் எத்திசை பார்த்தாலும் குற்றச்செயல் அதிகரித்துக் கொண்டு வருவதையும் பொது மக்கள் அச்சத்தில் நடமாடிக் கொண்டிருக்கின்றனர் எனவும் கூறினார். என்.கே.ஆர்.ஏ -வின் குறியீடு நடைமுறையில் நிகழ்வதை பிரதி பலிக்க தவறி விட்ட வேளையில், ஏன் இந்த குழப்பத்தை மக்களிடையே உள்துறை அமைச்சு ஏற்படுத்துகின்றது என கேள்வி எழுப்பினார்.

நாட்டு மக்களை பாதுகாப்பது அரசாங்கம், காவல் துறை மற்றும் உள்துறை அமைச்சின் தலையாய கடமையாகும். ஆனால் தற்போதைய நிலைமை மிக வேதனைக்குரிய நிலையிலும் அச்சத்திற்குரிய நிலையிலும் உள்ளது. மக்கள் அச்சமின்றி சுதந்திரமாக நடமாட இயலவில்லை என கூறிய சார்ல்ஸ்,மக்களுக்கு அச்சமின்மையான அமைதியான  மற்றும் நிம்மதியான சூழ்நிலையை உருவாக்க அரசாங்கம் காவல் துறை, அரசுசார்பற்ற இயக்கங்கள், இதர அரசியல் கட்சிகள்,குடியிருப்பாளர் சங்கம் ஆகியவைகளுடன் ஒன்றிணைந்து  காலத்தை கடத்தாமல் நடவடிக்கைகளில் ஈடுபட வேண்டும் என கேட்டுக் கொண்டார்.

POLICE-shooting victim Norizan Salleh never imagined she would ever be shot at. She describes how she felt lying on a highway near Gombak on 30 Oct 2009 after being shot five times by the police while on her way home: “I kept asking myself, ‘Betul ke, saya kena tembak? Is this what it feels like?’

“I felt my body and saw blood on my hands. My breath was becoming shallower and my hands were very cold. I wondered, ‘Is this how it feels like to die?'” Norizan tells The Nut Graph.

Norizan isn’t the only person to have been shot by the police in 2009. In August, two men were gunned down when they reportedly charged at the police with machetes after committing armed robbery in Shah Alam. Then on 8 Nov, police shot dead five men in Klang, also alleged armed robbers. Just a week later, police fatally shot a man who had reportedly run amok with a dagger in Guar Sanji, Perlis.

While we would certainly like to see less armed robbers and criminals on the streets, does it have to involve the police shooting suspects dead? Are there alternative means of apprehending these suspects alive? And who is policing the police to ensure that they are not indiscriminately using their weapons, thereby causing unnecessary deaths in the process?

Numbers game


Charles Santiago (file pic)According to Klang MP Charles Santiago, media reports show there were 39 deaths from police shootings in 2009. A Suaram press statement says in 2008, there were 44 such deaths. On average, that’s more than three deaths a month. And that’s not taking into account unreported shootings and deaths in police custody.

Yes, the police must surely have a right to defend themselves and those whom they protect from suspected criminals when life is being threatened.  But why is the death rate from police shootings so high in Malaysia? Consider this. In countries like the United Kingdom, with more than twice our population, there was only one fatal shooting by the police in 2006. In some years, there were none at all.

Unanswered questions

Suaram coordinator Lucas Yap says that the killing of individuals by unlawful police shootings is a common occurrence in Malaysia, although the precise number is difficult to ascertain.

“The circumstances of police shootings in Malaysia indicate that the police do not try to apprehend suspects alive but shoot with the intention to kill,” Yap tells The Nut Graph in an e-mail interview. “In virtually all cases of shooting deaths, the police claim that the suspects were armed and dangerous, that the suspects shot first, and that return fire was necessary.”

“Of course, police say they shoot in self-defence…But there are instances where it is difficult to justify their actions. Shooting is something that should be avoided,” Malaysian Human Rights Commission (Suhakam) commissioner Datuk Siva Subramaniam tells The Nut Graph in a phone interview.

Senior lawyer and former Bar Council president Raja Aziz Addruse says that proper justification must be given for the taking of a life. “Just to say, ‘Because they were shooting at me,’ is insufficient,” he says. “In many of these cases, there’s always a gun found in the car. It’s just too coincidental. Very often, all the people allegedly involved are killed.”


Siva Subramaniam”Police must justify how they use their firearms,” Raja Aziz says. “It doesn’t mean that in all these cases, they have to shoot to kill.”

Yap says that even if the claims of armed suspects are true, the police could consider other means of neutralising suspects, such as by using stun guns, tranquiliser shots or tear gas that are not lethal. “In the limited circumstances where shootings are warranted by law, suspects could be shot in the legs or arms and captured alive,” Yap adds.

“Whatever it is, a shoot-to-kill policy is against human rights,” says Siva. “The right to life is one of the basic rights which we should have to ensure.”

Accountability

Yap says that if suspects are shot dead by police, inquests must be held within a month to determine whether the police made any efforts to apprehend suspects alive. In the long run, a coroner’s court should be set up to investigate all deaths involving the police.

“Where killings are found to be avoidable, the police must be held accountable for their action,” Yap says.

Raja Aziz also cites the need for an independent tribunal to look into police shootings. “In other countries, an independent inquiry would be held to find out what happened,” he says. “For example, in the UK, an inquiry was held in the case of the shooting of Jean Charles de Menezes.” The inquiry eventually found the Met police force guilty of endangering public safety, and it was penalised for shooting de Menezes dead.

Raja Aziz says the Enforcement Agency Integrity Commission (EAIC) is inadequate to monitor the police, as its jurisdiction is too general. “With the rampant abuses that have been perpetuated by the police, there should be a proper, separate commission,” he says. “Also, police officers have much greater powers than those in other agencies such as the MACC, immigration or customs.”

Yap cites the United Nations Basic Principles on the Use of Force and Firearms by Law Enforcement Officials as a guide.

“Intentional lethal use of firearms may only be made when strictly unavoidable in order to protect life,” states Article 9 of the basic principles. The article states that discharging firearms is meant as a last resort, when less extreme means of protecting lives have proven insufficient.

Article 10 goes on to state that in using firearms, “officials shall identify themselves as such and give a clear warning on their intent to use firearms, with sufficient time for the warning to be observed.” This must be adhered to unless to do so “unduly places the law enforcement officials at risk or would create a risk of death or serious harm to other persons…”

Malaysia’s written guidelines for the police on the use of firearms is supposedly a “restricted” document which the public cannot access.

“So far, we have not managed to get a copy of the written procedures,” says Siva. “This will be brought up during our meeting with the police.” Attempts by The Nut Graph to get a copy from the Home Minister also went unanswered.

Political will

Raja Aziz says unless the government has the political will to deal with these issues regarding the police, nothing will change.

Recently, Home Minister Datuk Seri Hishammuddin Hussein reportedly said that police would be responsible for their actions, including shooting criminals in self-defence.

But with no inquest or inquiry in sight for the numerous deaths by police shootings, one has to wonder, just what does that mean? favicon

KLANG, 16 Jan: Menteri Dalam Negeri, Datuk Seri Hishammuddin Tun Hussein mesti menjelaskan berhubung penangguhan projek pembahagian ibu pejabat polis daerah Klang yang sepatutnya dilaksanakan awal tahun ini.

Sehubungan itu, Ahli Parlimen Klang, Charles Santiago mempersoalkan penangguhan itu sama ada menteri berkenaan ingin sabotaj dan menganaktirikan Klang dengan mengabaikan rakyat hidup dalam satu perkitaran yang selamat dan selesa.

Beliau menyatakan demikian sebagai mengulas kenyataan Ketua Polis Selangor, Datuk Khalid Abu Bakar baru-baru ini bahawa projek pembahagian ibu pejabat polis daerah Klang kepada Klang utara dan Klang selatan yang sepatutnya dilaksanakan pada awal tahun ini telah ditangguhkan kerana kesuntukan kewangan.

Baginya, kenyataan Khalid itu memang memeranjatkan kerana sejak tahun 2008, pihak polis telah memberitahu rakyat Klang bahawa projek itu akan dilaksanakan dan bilangan anggota polis akan ditambahkan untuk membanteras jenayah di kawasan Klang.

Katanya, jika projek itu telah dirancangkan dan satu tarikh tamat telah ditetapkan, ia mesti telah diperuntukkan kewangan yang mencukupi.

Tambahnya, pengumuman Khalid itu membangkitkan persoalan, di manakah peruntukan kewangan bagi projek ini, adakah peruntukan ini ditarik balik daripada kawasan pakatan rakyat, ataupun disalurkan kepada projek lain.

“Mana satu projek lebih penting daripada memperuntukkan sumber untuk menjaga keselamatan rakyat,” ujarnya dalam satu kenyataan kepada Harakahdaily, hari ini.

Menurutnya, alasan kesuntukan kewangan amat tidak masuk akal kerana kerajaan Pusat telah memperuntukkan pakej rangsangan ekonomi sebanyak RM67 bilion, jadi mengapa projek pembangunan di dalam senarai boleh hilang selepas aliran masuk sumber kewangan lagi banyak daripada pakej rangsangan ekonomi.

Katanya, langkah itu satu set back kepada petunjuk Prestasi Utama Nasional (NKPI) Perdana Menteri iaitu mengurangkan jenayah indeks dengan memberi tumpuan kepada jenayah jalanan dengan sasaran pengurangan sebanyak 20 peratus menjelang penhujung tahun 2010.

Beliau berkata, dalam jawapan parlimen November 2009, Kementerian Dalam Negeri mengaku Klang telah dikenalpasti sebagai salah satu kawasan yang kerap berlakunya jenayah atau hotspot di Selangor.

Kementerian juga berkata, ia telah melaksanakan strategi menempatkan lebih ramai anggota polis untuk menjalankan tugas-tugas rondaan termasuklah anggota polis pasukan gerakan am khususnya di Selangor dan Kuala Lumpur.

Usaha juga sedang dilaksanakan untuk memasang 16 unit kamera litar tertutup (CCTV) baru di kawasan parlimen Klang berdasarkan lokasi yang dikenalpasti oleh PDRM.

Katanya, dengan menempatkan lebih ramai anggota polis untuk rondaan dan memantau CCTV, kementerian memang perlu meningkatkan infrastruktur bagi pasukan polis kawasan Klang, projek pembahagian ibu pejabat polis Klang kepada dua harus dilaksanakan.

“Saya menyaran agar Menteri Dalam Negeri mengkaji semula keputusan ini dan memastikan projek pembangunan ini dilaksanakan dalam tahun ini.

“Saya juga menggesa Kementerian Dalam Negeri menstruktur semula dan membawa modenisasi kepada PDRM dengan mengurangkan anggota polis dalam unit FRU, cawangan khas dan pengurusan, memindahkan anggota-anggota ini ke jabatan siasatan jenayah, ujarnya.

Ini, katanya bermaksud Kementerian Dalam Negeri mesti memastikan PDRM berkhidmat kepada rakyat dan bukan berkhidmat kepada tujuan politik.

KLANG – Klang MP Charles Santiago said remarks by Selangor’s top cop against a state executive councilor were ‘ridiculous’ and ‘the most preposterous statement a police officer could make.’

charles-santiago-2.pngSantiago was referring to a statement by Selangor police chief Khalid Abu Bakar that Seri Kembangan state assemblyman Ean Yong Hian Wah was trying to intimidate the force.

Yong had suggested that the police stop their investigation of Penang Chief Minister Lim Guan Eng, who had allegedly made seditious remarks in relation to the Teoh Beng Hock inquest.

Lim, referring to findings by Thai pathologist Dr Pornthip Rojanasunand that Teoh’s death was 80% homicide, had said the political aide was murdered.

Khalid’s remarks against Yong

At the time of his death in July, following questionings by the Malaysian Anti-Corruption Commission (MACC), Teoh was the political secretary to Yong.

Khalid had rkhalid-abu-bakar.pngeacted to Yong’s statement by saying that “the honourable member  should not try to intimidate us (the police) by directing us to cease the investigation of Guan Eng.”

“Whatever the reason could be, Khalid’s accusation against Hian Wah is ridiculous,” said Santiago, claiming that Malaysians are aware of the political high drama by the ruling elite to regain control of Selangor.

Santiago added that the action of the police of going after Lim for saying Teoh was murdered is “taking it too far.”

Lim, who is also DAP secretary-general, was only referring to Dr Pornthip’s report and her expert observation is echoed by most Malaysians, the Klang MP added.

Santiago alleged that the theory that Teoh committed suicide did not hold water as the political aide was going to get married a day after the interrogation by the MACC.

Furthermore, he claimed, a letter written on MACC stationery that hinted there was more to Teoh’s death than meets the eye also alluded to the fact that the young political aide did not plunge to his death.

ean-yong-hian-wah.jpgSantiago also alleged that the ‘web of tales’ spun around Lim as well as police claims of intimidation were attempts by the Barisan Nasional government to divert the public’s attention from the issue of two missing F5-E jet engines, the controversial Biro Tata Negara (BTN) courses, the Port Klang Free Zone fiasco and the Umno-Gerakan in-fightings, among others.

People want ‘real changes’

Santiago said Prime Minister Najib Abdul Razak must know by now that Malaysians are not ‘fans’ of  authoritarianism and dictatorship.

As the year ends, this is what I would regard as the most preposterous statement a police officer could make – “I wish to stress that the honourable member should not try to intimidate us by directing us to cease the investigation of Guan Eng.”

Selangor’s police chief  Khalid Abu Bakar said this in relation to Selangor State Executive Councillor and  Seri Kembangan state assemblyman Ean Yong Hian Wah’s statement in the media directing the police to cease their investigation of Penang Chief Minister Lim Guan Eng as it seemed like an attempt to intimidate the police.

Khalid’s defensiveness could stem from the fact that he does not want the public to know that the police force is being used by UMNO to tarnish the image of the Pakatan Rakyat-led government in Selangor.

Whatever the reason could be, Khalid must be told that his accusation against Hian Wah is ridiculous. UMNO spin doctors, including the police, are clearly in deficit of their creative thinking.

And just so that Khalid knows, Malaysians are aware of the political high drama by the ruling elite to regain control of Selangor.

Old habits die hard. We all know that the police force takes orders from the ruling elite. But going after Penang Chief Minister and DAP Secretary-General Lim Guan Eng for saying Selangor State Exco’s political aide Teoh Beng Hock was murdered is taking it too far.

Lim Guan Eng was only referring to Thai Pathologist Dr. Pornthip Rojanasunand’s report that Teoh’s death was 80% homicide. Dr Pornthip’s expert observation was echoed by most Malaysians.

The theory that Teoh committed suicide simply did not hold water and specifically because he was going to get married the next day after the MACC interrogation. But the current web of tales spun around Guan Eng’s alleged statement and police claims of intimidation is the Barisan Nasional government’s new attempt to divert the public’s attention from the two missing F5-E fighter jet engines, racist BTN courses, unfinished Port Klang Free Zone financial fiasco and also infighting between UMNO and Gerakan.

Najib, is once again right in the center of the muck, as the jet engines amounting to RM100 million went missing in 2007 when he was the Defence Minister. It is also learnt that a police report was lodged one year ago and submitted to the Attorney General’s chamber about six months ago.

So, the lingering questions zero in on why no action was taken till now? Did Najib intervene in the investigation by the police? Were there orders to delay or maybe close the investigation papers?

Instead of focusing on this probe which is a matter of national interest, the police are harping on Guan Eng. Therefore, clearly the sedition investigation is politically motivated.

Najib’s government is playing dirty to throw out Pakatan Rakyat from power. His stooges are gunning for opposition politicians.

Opposition leader Anwar Ibrahim is facing a sex trial, Tian Chua was charged for ‘biting’ the police, some Parti Keadilan Rakyat’s youth leaders were arrested by police for distributing flyers and are expected to be charged under Sedition Act and the DAP Taiping lawmaker Nga Kor Ming was questioned by police over the mosque allocation remark.

Najib must know, by now, that Malaysians are not a fan of authoritarianism and dictatorship. The people want real change which ensures human rights, freedom of expression and an accountable and clean government.

Therefore, Najib must drop his maneuvering tactics and the police force must stop its intemperate allegations, laced with wild accusations against opposition representatives. I also call upon the police to drop all investigations against Guan Eng and Hian Wah and instead make concerted efforts to prevent the rising crime rate in the country.

But again, no one doubts the capacity of Najib, UMNO or the police force to surprise.

警察调查捍华冠英 掩饰巫统丑闻内斗

当岁末将至,我认为这是一个警官能够做出的最荒唐言论 – “我希望议员不要尝试恐吓我们,要求我们停止调查林冠英”

雪州总警长卡立阿布巴卡指出,雪州行政议员兼斯里肯邦岸欧阳捍华发表文告促请警方停止调查槟州总警长林冠英,乃是恐吓警方的做法。

卡立的防卫性言论,显示他尝试掩饰巫统利用警察抹黑雪州民联政府。

无论基于什么理由,卡立必须知道他指责欧阳捍华的言论非常荒唐。巫统的政治化装师,包括警察,显然地已创意破产。

就像卡立所知道的,大马人也意识到国阵政府策划夺回雪州政权。

我们全知道警察根据国政政府的指示行事。但是以煽动言论调查槟州首长林冠英发表“雪州行政议员政治助理赵明福被谋杀”的言论已是太过分。

林冠英只是引述泰国法医普缇的报告,普缇指赵明福有80巴仙的可能性是被杀,大多数大马人也支持普缇的观点。

赵明福自杀的理论经不起考验,因为他在反贪委员会调查的隔天将注册结婚。一封以反贪委员会信头发出的信件暗示赵明福并非单纯坠楼而死。

调查欧阳捍华和林冠英是国阵政府尝试转移公众注意力的伎俩,尤其是当国阵深受两个战斗机引擎失踪、被指渲染种族主义情绪的国家干训局课程、还未完结的巴生港口自贸区丑闻、巫统和民政党争执槟州领导种种议题的困扰。

纳吉依然是这些丑闻的中心人物。两个价值一亿令吉的战斗机引擎是在他担任国防部长的2007年从守卫森严的军营里失踪。据悉。此弊案的报案书一年前已在警察手上,六个月前已呈交给总检察署。

所以,为什么政府至今没有采取任何行动?纳吉是否妨碍警察的调查?是否有任何指示延缓或停止调查?

警察不但不致力调查这个攸关国家利益的案子,反而把枪口指向林冠英,这清楚显示煽动言论的调查具有政治目的。

纳吉政府打算以肮脏手段推翻民联政府,他的配角们正集中火力攻击反对党政治领袖。

反对党领袖安华面对肛交指控,蔡添强被控“咬伤”警察,公正党青年团领袖因分派传单而被逮捕及可能在煽动法令下被控,行动党太平国会议员倪可敏因为回教堂拨款的言论而被警察盘问。

纳吉必须知道,大马人现在已非专制主义和独裁者的拥护者。人民追求能够保障人权、自由表达意见、具有公信力和干净的政府的真正改变。

因此,纳吉必须放弃他的卑鄙计划,警方也必须停止肆无忌惮和毫无基础地指责反对党领袖。我也促请警察撤销针对林冠英和欧阳捍华的调查,反之应把时间花在努力克服不断提升的国内犯罪率。

但是,没有人会怀疑纳吉、巫统和警察会再次让我们吃惊。

(吉隆坡)以柔佛大馬人民之聲(SUARAM)為首的35個非政府組織來國會向行動黨國會領袖林吉祥請願,他們促請全國總檢察長撤銷對捍衛住屋權益,阻止發展商拆屋而向警方報案的鍾立薇控狀。

27歲的鍾立薇是於2008年10月16日,因捍衛新山甘榜峇魯避蘭東登雅村民的權益,到新山百萬鎮警局報案,警方在17日晚上傳召鍾立薇到警局錄口供,過後援引內安法令扣留她19小時,還援引刑事法典提控她。

35個非政府組織代表指出,鍾立薇的報案書內容並無虛假,反而是警方動員協助發展商拆屋逼遷的行動是錯誤的,因為新山高庭還在審理展緩執行令的訴訟,在判決前,發展商不應該強行拆屋。

“總檢察署提控鍾立薇等同對人權工作者的持續迫害,她報案不是個人行動,而是代表大馬人民心聲,如果她被起訴將是大馬推行民主的一個大諷刺。”

林吉祥認為,鍾立薇並無犯罪,她只是去報警,警方不至於使用內安法令或刑事法典對付她。

撥5000萬製作本地影片

新聞、通訊及文化部長拿督斯里萊士雅丁指出,大馬多媒體與通訊委員會將於明年獲得5000萬撥款製作本地影片,尤其是紀錄片,以推廣到海內外市場。

他說,該部希望透過本地製作的紀錄片,展現大馬紀錄片的特色,目前本地創作影片因經費不足,難以達到國際水平。

萊士雅丁是在國會下議院回答萬捷國會議員納沙魯丁的附加問題時說,2010年開始,政府將增添更多本地動畫片、紀錄片、連續劇等,包括東馬製作的影片。

他說,該部將與數家紀錄片製作公司合作,即探索頻道(Discovery Channel)及國家地理頻道(National Geographic)聯合製作有關神山、砂拉越尼亞石山及兩個被聯合國教科文組織列為世界文化遺產的馬六甲和檳城的紀錄片。

他披露,該部過去透過大馬多媒體與通訊委員會與國家電影發展局及大馬國營電視台合作,製作許多成功入圍康城影展及享譽國外如澳洲、東京及香港的紀錄片。

新聞、通訊及文化部副部長拿督佐瑟沙朗說,政府目前無意提供全國免費寬頻網絡服務,不過已經在數個城市率先提供免費服務。

他在國會上議院會議,回答上議員慕哈末尤索夫時表示,一些公共圖書館也設有免費的寬頻上網服務。

人民之声拉队到国会声援钟立薇

吉祥承诺动议辩论警方无理逮捕

大马人民之声柔佛分会等35个非政府组织代表今午到国会大厦,会见民主行动党国会领袖林吉祥,并派发支持函给朝野议员,要求关注人权工作者钟立薇在执行工作时,反遭逮捕复提控一事。

捍卫住屋权益反遭逮捕提控

cheng lee whee isa arrest 181008 01钟立薇是在去年10月16日因为捍卫住屋权益,阻止发展商拆毁新山甘榜巴鲁避兰登雅村的屋子,而到警察局报案,但却反遭警方援引内安法令逮捕,被扣留19个小时。

接着,她更于今年10月14日被新山地庭,以《刑事法典》第182条文提控,案件将于本月16日开审。

柔州35个党团已经在11月24日,联署一份备忘录呈给总检察署,要求撤销对钟立薇的指控。

逮捕人权工作者是民主讽刺

35个非政府组织代表陪同钟立薇,在国会走廊召开记者会,念出这份联署备忘录。林吉祥过后承诺,他将会在近日内,向下议院内提呈动议,要求辩论此事。

林吉祥表示,钟立薇只是以人权工作者的身份执行工作,并没犯罪,根本就不应受到对付。

他强调,除了警方不应以内安法令逮捕钟立薇外,总检察署更不应以刑事法典提控这名人权工作者。

他炮轰总检察署提控钟立薇,如同对人权工作者的持续迫害,更是对我国民主的莫大讽刺。

向朝野议员派函冀支持动议

较后,钟立薇的支持者也在国会派发支持函,给国会走廊的朝野议员,希望这些议员能支持林吉祥的动议。

钟立薇是人民之声新山支会工委(人权教育与支援小组组长)。当警方以内安法令逮捕她时,曾到钟立薇家中搜证,并且没收了她的手提电脑和记忆笔。

林吉祥指違反人權

促撤銷鍾立薇控狀

(吉隆坡10日訊)民主行動黨國會領袖林吉祥促請首相與總檢察長,撤銷人權工作者鐘立薇被指在新山百萬鎮警局報假案的控狀。

他說,有關指控違反人權,因鐘立薇只是到警局報案,就被警方援引內安法令扣留,然后在刑事法典第182條文下被控。

他要求首相拿督斯里納吉以人權角度考量此事,認為這是政府濫用內安法令對付不滿國陣政府人士及社會工作者的事件。

另外,針對檳州升旗山區部主席阿末依斯邁獲提早解除凍結黨籍,林吉祥認為,政府根本不重視國民團結。

他說,阿末依斯邁早前發表的言論與國家干訓局課程,同樣有種族主義。

針對巴生港務局前任總經理馮惠珠及另兩人被控一事,林吉祥認為,這只是一個開始,因最大的涉案者還沒受到對付。

KLANG – Like the soaring crime rate in Malaysia, public anger against the police is also on the rise, said Klang MP Charles Santiago.

He suggested that the government resolves crime from a development perspective rather than the – tried and failed – law and security approach.

This, he added, would involve creating jobs, offering skills training and providing loans and small contracts to vulnerable youths, especially the Indian youths.

Santiago said essentially, the government at the Federal, state and local levels have to create an enabling environment with a view of creating opportunities for the poor and lower middle classes to be socially and economically mobile.

“The present ‘trigger- happy’ approach is not going to solve the crime problem that confronts us,” he said in a statement here Friday.

‘Random shooting is a fact’

He cited the incident in Taman Klang Utama, where police shot dead five suspected robbers in a shootout after a high speed car chase at 12.30am on Sunday.

Overcome by grief over the death of her brother, who was one of those shot and killed in the incident, a 31-year-old housewife and two of her children are now fighting for their lives after consuming paraquat, a weed killer.

Santiago said besides the woman’s 24-yeaer-old brother, a 17-year-old boy was also killed.

He said while those shot were robbery suspects, the action of the police had amounted to being ‘trigger-happy.’

He said Home Minister Hishammuddin Hussein might not agree with accusations that the police have been indulging in random shooting “but this is a fact.”

“The police force has come under fire one too many times for abusing its power.

39 killed in shootouts last year

“Media reports state that at least 39 people were killed by police in shootouts for the whole of last year.”

Santiago refuted recent remarks by Hishammuddin in Parliament that put the blame for the country’s high crime rate on the ‘bad-mouthing and demonisation’ of the police force.

The minister also said that institutions like the police force are made to be seen as ‘irresponsible and bad’ while they were only trying to do their jobs.

Santiago said: “The Home Minister never fails to puzzle us through his statements.

“Hishammuddin leaves us wondering if he is duty-bound to protect the image of the police force.

Tilted towards rampant abuse

“Or, is the man, touted as a future Prime Minister, only capable of non-ideological analysis?” Santiago asked, adding that  Malaysia does not have the luxury of time to indulge in such “musings” as the country’s balance is tilted towards rampant abuse of police powers and a growing sense of insecurity among the public.

The Klang MP, on the other hand, put the blame for the high crime rate squarely on the police.

He added that the delays in the various trials and judging process were also factors for the escalation.

He said the police must work independently and efficiently to cut down the crime rate, adding that as an infant step, it should first focus its efforts on wiping out graft.

“Wearing badges which scream an end to corruption would not work without instilling discipline among its members,” said Santiago. – Malaysian Mirror

The Malaysian Home Minister Hishammuddin Hussein never fails to puzzle us through his statements. Two days ago, in Parliament the Minister blamed the country’s high crime rate on the bad-mouthing of the police force and demonisation of the institution.

“Institutions such as the police force are made to be seen as irresponsible, as bad when they are also at the same time just trying to do their jobs. Besides PDRM, the delay in the various trials and judging process is also one of the factors for the escalation of the nation’s crime rate,” he said.

Hishammuddin’s mindless quotes leave us wondering if he is duty-bound to protect the image of the police force. Or is the man who is touted to become the country’s future Prime Minister only capable of non-ideological analysis?

But we certainly do not have the luxury of time to indulge in such musings as the country’s balance is tilted towards rampant abuse of police powers and a growing sense of insecurity among the public.

The scene of chaos at the Intensive Care Unit, Tengku Ampuan Rahimah hospital in my constituency of Klang, would certainly not appease Malaysians.

A 31-year-old housewife and her two children are fighting for their lives after consuming paraquat. The mother of four is reported to have resorted to suicide as she is overcome by grief over the death of her brother who was shot and killed by the police on Monday. Her other two children are undergoing treatment in a normal ward.

The victim 24- year- old, R Surendran, was one among the five who was shot dead for allegedly being a member of a gang that was responsible for a spate of robberies. This might be true. A 17 year old youth was also killed. But the action of the police amounts to trigger-happy.

Hishammuddin might not agree with accusations that the police have been indulging in random shooting but this is a fact.

The police force has come under fire one too many times for abusing its power. Media reports state that at least 39 people were killed by police in shootouts for the whole of last year.  But Hishammuddin’s skewed political philosophy clearly shows he is not shy about championing the force.

Public anger against the police, wrapped under the surface calm, is on the rise. Just like the soaring crime rate despite the decrease in designated hot spots. Plans to disburse RM 90 million to the police to upgrade facilities and police stations throughout the country is not a durable solution.

The government needs to resolve crime from a development perspective as opposed to the — tried and failed – law and security approach.  This would involve creating jobs, offering skills training and providing loans and small contracts to vulnerable youths, especially Indian youths.

Essentially, the government at the federal, state and local levels have to create an enabling environment with a view of creating opportunities for the poor and lower middle classes  to be socially and economically mobile.

The present trigger- happy approach is not going to solve the crime problem that confronts us.

In the short run, the police force must, instead, work independently and efficiently to cut down the crime rate. As an infant step, it should first focus its efforts on wiping out graft. Wearing badges which scream an end to corruption would not work without instilling discipline among its members.

I call upon the Selangor CPO to institute a public inquiry involving various stakeholders to investigate the killing of the 5 Indian youths. The public inquiry should explain why these men were not arrested as suspects, charged in court, and if found guilty, sent to prison.

And Taking note of the incidences of random shooting by the police, deaths in police custody and other abuses I urge Prime Minister Najib Tun Razak to implement the recommendations of the Independent Police Complaints and Misconduct Commission (IPCMC) to offer a check and balance to the force.

This would not just increase the integrity of the police in the eye of the public but also reflect positively on the police force.
